<br />Beikman should investigate if the existing garage work was done without a building <br />permit. Anyone could see from the pictures there is no room for this project and this is <br />not in the best interest for the area. <br /> <br />Rirune.r <br />Motion was made by Mr. Burner, second by Mr. Pygman, to continue the Rezone ofR-1 <br />to R-3 for property at 103 W. High Street until the January meeting. Motion carried 6-2. <br /> <br />Next on the agenda was Ross Hollowy, Holloway & Associates, representing Mr. Carroll <br />Herrin, IS60 Observatory Road, request a Rezone from Agriculture to Residential. The <br />Herrin Minor Plat is off what was Sunset Lane before State Road 67 cut it off now the <br />access is a private driveway off of Observatory Road. This is a two lot Minor Plat with <br />Lot I being over nine acres and Lot 2 being a little over 2.4 acres. It is accessed by a <br />twenty-five wide foot utility easement, there is public water on site, and they have turned <br />in soil sample for evaluation. They have a site evaluation from the Morgan County <br />Board of Health stating the soil is suitable for septic system. They have provided a <br />Covenant and restrictions called for the care and maintenance of the driveway. With that <br />Mr. Hollowy asked for any questions from the Board. <br /> <br />Mr. McGuire asked the Chairman if this had come before the Tech review committee and <br />was told it had. The only thing the Tech review requested was the access utility easement <br />and septic permit. Everything else on the checklist was fulfilled. Mr. Holloway said <br />there was a thirty-four foot wide access utility easement and a septic permit was <br />provided. <br /> <br />Motion was made by Mr. McGuire, second by Mr. Crouch, to approve the request for a <br />two lot Minor Plat. Motion carried 8-0. <br /> <br />411olllA^/ <br />Next on the agenda was Ross Hollowy, Holloway & Associates, representing Mr. Jeremy <br />Hopkins, IIOSO Bethel Road, requesting a two lot Minor Plat zoned agriculture. Mr. <br />Holloway said this was a two lot Minor Plat, however upfront statement that Lot 2 is not <br />shown, but is shown as the remainder of parent parcel, which is approximately sixty <br />acres, with a total of sixty-four acres parcel. There are a number of ways to do this, we <br />understand that it is restricted now and the whole parcel would be under the Minor <br />Platting. In the past they have shown it this way in which they shown in detail where it <br />was located in the parent parcel and then labeling it Lot 2. They are open to any <br />suggestions on how to do that. It is a two lot Minor Plat and they need to show it as Lot <br />2, with them showing dedicated driveway off of Bethel Road. They are in the process of <br />getting a soil test, they do not have that, but see no reason for the soil in this area <br />wouldn't be suitable for a single family residence on five acres. Their approval will be <br />subject to getting an acceptable soil report from the County Board of Health, they have <br />shown the forty-foot building line, they understand they need a dedicated driveway and a <br />forty-foot building line for Lot 2, which will be the remainder of the property off Bethel <br />Road. With those restrictions and conditions they asked for approval for the two lot <br />Minor Plat. <br />
