May 22, 2003 and give Mr. Boncquet the opportunity to withdraw and go for a variance
at the Board of Zoning Appeals or come back for a re-zone. The motion carried with a
vote of 7 -I opposed was Commissioner Williarnson. It was discussed that a variance
would have to be filed for the June meeting. Also, that parking didn't have to be paved,
but five 9' by 20' spaces with a solid rock base, if a variance.

Next, Ross Holloway, appeared to request a change in the plat before recording. The
retirement units previously approved for Lakeside Commons, first phase, were forty feet
by fifty feet in size. The Shae Corporation decided they would rather have these units
forty five feet by fifty five feet in size. The location and number of units would not be
changed. Since this was a minor change, Mr. Holloway carne to the meeting to ask their
indulgence on the changed plat. Mr. Holloway told the commission that there would still
be ten feet between the units. He said they may lose some density and may have some
changes to backyard sizes. They also added to the plat that after seventy units were built
the community center would be constructed. A motion was made by Commissioner
Ehrhart, second by Commissioner Williarnson to approve the changes to the plat for
Lakeside Commons. Motion carried 8-0.

In other business, Joe Beikman, Building Inspector, told the commission the county had
changed their rules and they would not come to Mooresville to pick up the plats to be
recorded. He suggests the plats be signed at the meeting and handed right back to the
people that brought them in to record.

Mr. Beikman also told the commission that two years ago a request for mini warehouses
on Allison Road was denied and he had a complaint that makes him think these units are
being rented and would like to know what the commission suggests to do about this issue.
He told the commission the units were built before they carne to the BZA for a variance.
He said the complaint came from a man who had gone there for a yard sale and there was
a for rent sigu on the table. Attorney Tim Currens told Joe Beikman to verify that renting
was happening and notify Mr. Currens and he would send a letter.

The letter to the commission about the unfenced pool located in Woodland Hills was
unsigued. Commissioner Bryant said he thought there needed to be a fence.
Commissioner McGuire said for safety reasons this letter needed to be checked out and
then Tim Currens will send a letter.

Joe Beikman, Building Inspector, reported twenty-nine (29) permits and sixty- two (62)
inspections. He also reported getting a judgement against properties located at 40 East
Main Street and 101 East South Street and that 39 West Main Street was in the works.
The next round would be public advertising.

A discussion concerning voting by paper ballots ensued. Commissioner Corbin said that
sometimes paper ballots were used and sometimes they were not used. Commissioner
Bryant said that he was new to the process but he did not care for them. He said that if a
person was not willing to raise their hand to vote, maybe they need to step aside and let
someone else have their position. Commissioner Ehrhart told the commission because
