<br />MOORESVILLE PLAN COMMISSION <br />MINUlES <br />THURSDAY, AUGUST 28,2003,7:00 P.M. <br /> <br />The Mooresville Plan Commission met on Thursday, August 28,2003 at 7:00 P.M. at the <br />Mooresville Town Hall. <br /> <br />Commission members present were: Chairman, Mike Young, Chris Crouch, Jim Bruner, <br />Troy Bryant, Robert Williamson, Robert Corbin, John Ehrhart, Tim Bennett, and Charles <br />McGuire. Town attorney, Tim Currens was present. <br /> <br />The first item on the agenda was the rezoning of 40 E Main Street from Residential to B- <br />2. The property is currently owned by Grace Parr, who now lives out of town. <br />Representing Grace Parr was Lori Kinnett, who has made an offer to purchase the <br />property contingent on it's being rezoned. Ms. Kinnett wants to put a consignment shop <br />in the home. Commissioner McGuire stated that a residential home does not comply with <br />the B-2 zoning requirements. Ms. Kinnett stated that when she came in to find out what <br />she needed to do she was told to ask for a rezone to B-2. On the question of parking, Ms. <br />Kinnett stated that she was told she needed six spaces and presented the board with a <br />diagram showing where the six spaces could go. Commissioner McGuire stated that he <br />would much rather see a variance issued on the property than a rezone. Ms. Kinnett <br />replied that she initially wanted a variance so that she might someday resell the property <br />as a residence but was told she needed a B-2 rezone instead. Chairman, Mike Young <br />explained to Ms. Kinnett the process for seeking a variance from the Board of Zoning <br />Appeals but didn't think she could meet the deadline requirements for the September <br />meeting. When asked if she was officially withdrawing her request for a rezone, Ms. <br />Kinnett stated she was not. A motion was made to grant a continuance by Commissioner <br />McGuire, second by Commissioner Ehrhart. Motion carried 9-0. <br /> <br />Ross Holloway of Holloway Associates appeared before the commission for Wendell and <br />Lois Thaler, asking for a 2-lot minor plat on Bethel Road north of Crosby Road. Wendell <br />Thaler currently owns the 3.2-acre lot and wants to divide it so his daughter Kim can <br />build a house. Mr. Holloway stated that the plat has been arnended wherever possible to <br />meet the comments of the Tech Review Committee. He also stated that the length to <br />depth ratio was a problem for this parcel because it couldn't be divided in any manner <br />without exceeding the width to depth ratio since the total frontage is 250 feet and the total <br />depth is almost 600 feet. Due to this, Mr. Holloway asked for a waiver on the length to <br />width ratio. Mr. Holloway stated that the lots have adequate space for nice homes and <br />accessory buildings, while still being a good distance from the road. The property is <br />serviced by public water. Copies of the septic and driveway permits have been filed <br />with Joe Beikman's office. Commissioner Bruner asked if the septic perk test was okay <br />and Mr. Holloway provided the commission with a copy of the test for review. He went <br />on to explain the operation of a pump system, which is required on this property. <br />Commissioner Crouch asked if a perimeter drain was required. Mr. Holloway said no. <br />Commissioner McGuire made a motion to accept the minor plat as presented, with the <br />
