<br />Next Ross Holloway, representing Value Plus Pharmacy, State Road 267, was requesting a <br />rezone from B-2 to B-3. The zoning in the area warrants this property should be B-3. The <br />existing building is 23, 470 sq. ft. and that means the zoning should be B-3. Mr. Richhart would <br />like to do something with the building. Commissioner Ehrhart said the town did not need <br />another teenage nightclub and Commissioner Bryant said we could restrict the nightclub or <br />tavern activities. Eric Shields, Town Council, asked if they could say what they were planning <br />on using the building for and Mr. Holloway said he could not. <br /> <br />Motion was made by Commissioner McGuire, second by Commissioner Corbin, to recommend <br />to the Town Council to rezone Richhart Value Plus Pharmacy, State Road 267 from B-2 to B-3, <br />with the restriction of use of a nightclub, tavern and dog kennel. Motion carried 8-0. The <br />rezone will go to the Town Council on March 16,2004. <br /> <br />Next Mr. Holloway, representing Robert Gregory, on State Road 42, was requesting a two lot <br />minor plat. This consists of two parcels; Lot I being 24.11 acres this will contain the existing <br />apple house and Lot 2 being 1.84 acres, which there will be proposed use. Lot 2 has 250 feet of <br />frontage and Lot I the frontage is split, 197 ft. in from of the apple house and 328 ft. from the <br />existing house lot line. They propose to access the existing entrance to the apple house and they <br />have allowed for a forty-foot access and utility easement that will stretch from the existing <br />entrance. They will be applying to the State Highway Department for a new driveway permit, <br />so they wanted a way to get onto the parcel now that was both safe and existing. They have <br />submitted a soil report and it is suitable for a septic system and there is public water available. <br />Mr. Crouch asked what the problem might be in getting the drive permit and Mr. Holloway said <br />it might be a sight problem and that is why they were submitting the drive easement. Mr. <br />Williamson asked if the drive was pavement and he said it was gravel. <br /> <br />Wanda Tomlinson, 921 State Road 42, stated her concern was the drainage problem and the <br />drive entrance. She said they have a drainage problem when it rains. Mr. Holloway said for a <br />single-family residence there would not be any impact, but if it is to be used for any other use <br />there would have to be an on sight retention and some other things. She feels the safest entrance <br />is the existing one. <br /> <br />Commissioner Bruner asked if it would be a public hearing on the driveway permit and Mr. <br />Holloway said it would not be. <br /> <br />Commissioner Williamson, second by Commissioner Crouch, made motion to approve the two <br />lot minor plat for Robert Gregory on State Road 42. Motion carried 8-0. <br /> <br />Next was Ross Holloway representing Robert Gregory, State Road 42, requesting a rezone from <br />Agriculture to B-3 for Lot 2 only. They are proposing to construct a Country Feed Store for <br />animal supplies. They submitted pictures and drdwings of how the structure would look. It will <br />be a country type building about 9,000 sq. ft. Because of the size of the building they are <br />requesting a B-3 zoning. Therefore they are requesting that it be restricted only to agriculture <br />related sale of feeds, animal health supplies and similarly related supplies. They are open to any <br />kind of language that will help the board restrict the rezone along this line. They feel that if this <br />was any other place, but beside the apple house, which is already a seasonal agriculture business <br /> <br />2 <br />
