<br />Commissioner Berwick asked where the road will come out on Keller Hill Road, can <br />people see? Mr. Holloway said there is a site issue and probably they will have to lay <br />back part of the slope. Mr. Wise said if this is an upscale community then put in lights on <br />the entrance road and curbs so people could not park at all and do it right from the <br />beginning. Address the problems before the get started. <br /> <br />John Haas, 830 E. St. Rd. 42, said his property is to the south of this project and it is all <br />down hill. His major concern is septic fields going into the lakes and the erosion causing <br />silt accumulation in the lakes. There will be a major problem getting to lot 4 & 5 because <br />that is swamp. <br /> <br />Mr. Holloway told him the ordinance calls for them to show two septic fields and they <br />can commit to this and each septic field can handle a four or five bedroom home. They <br />would be willing to put in the covenants to have the field sites and drainage engineered <br />designed for each lot. Mr. Holloway explained they were asking for a zoning change for <br />tonight so they can proceed with the most expensive part of the project which is the <br />engineering. A zoning change for a PUD requires you have a plan, not a final plat, for <br />what you are submitting. They will be in later for a preliminary and final plat approval. <br />At that time they will be providing approved construction plans, an erosion control <br />permit, a drainage permit, water line permit by IDEM, county driveway permit, and any <br />bonding required. <br /> <br />Dawn Littlejohn voiced concern about Lot 10 which is 2.3 acres and straight downhill <br />and where is the septic going? It will go down on us. Mr. Holloway said it does have <br />some severe topography and if there cannot be an area found suitable for a septic system <br />it will be incorporated into Lot 7 or Lot 9. He reminded the people that two of the lots <br />could pull a building permit tomorrow because they are part of a recorded Cash Minor <br />Plat. Mr. Wise said that is why no one has built there because it is straight up. <br /> <br />Commissioner Berwick said something would have to be done about the water coming <br />down on the people who spoke tonight. Mr. Holloway said they were requesting a <br />zoning change tonight and will have to come back for preliminary plat approval which <br />would be the appropriate time to make sure that all the questions brought up tonight have <br />been answered to the commission's approval. <br /> <br />A motion was made by Commissioner Ehrhart with a second by Commissioner <br />Williamson to recommend to the Town Council to rezone this property from Agriculture <br />to PUD- R with stipulations of minimum dwelling size of 2400 square feet, one utility <br />building with the same covenants as far as building requirements that refer back to item <br />#7 of Jessup Place covenants and restrictions, same roof pitch, not larger than living <br />space of home and no closer than fifty feet to any property line, cul-de-sac 45 foot of <br />pavement and radius of 55 feet. Other issues not included in rezone will be handled later. <br />The covenants and restrictions will follow thru with the rezone. Motion carried 6-2 with <br />Commissioner Brown and Berwick opposed. This request will go before the Town <br />Council at their June 7th meeting. <br />
