July 7, 1998 Town Council meeting. Agenda Topics-SR144

(property now known as Morgan Co. Garden Center)
Mr. Holloway stated to the Plan Commission on June 25, that it
had not yet been determined what kind of business would be
placed on this property, but was requesting B-3 zoning. Mr.
Holloway f'mished his June 25 presentation by requesting an
amendment to the original request of B3 to B2 zoning. He then
made the statement "what is planned could fall in the B-2
classification"! He is obviously not being up front and honest with
the Plan Commission, and is withholding information that he feels
would be undesirable to the Commission, Council, and residents of
this area.

In his attempt to get this property re-zoned Mr. Holloway also said
the main concern of the residents opposing the B3 zoning was the
fear of a tavern etc. on this property, and B2 would solve the
problem. He also had changed the original request for two plats up
to five plats. We do not know what he may try to confuse us and
the Town Council with during his appeal on July 7.

It is our belief that he will appeal to the Town Council using this
same strategy on July 7, most likely adding other misconceptions
and untruths about the neighborhood and the real concerns of the
residents. He will also use the fact that the Plan Commission
approved B-1 that same night for a business across the highway.

(concerning that business---Attorney Office)
The Town Council must be made aware that the attorney office
that received approval from the Plan Commission was operating
for about a year illegally and was notified of their infraction and
that they must go through proper channels to reqriest rezoning. The
attorney, Susan Neely, defended her position stating she had been
miss-informed by the Mooresville Town Hall as to the location of
