stated Mr. Lee's home towers over this property. Mr. Banning also said a single family home on <br />the property in the petition could not meet side yard setbacks requirement. He also disputes <br />traffic being heavy on Bishop street. These Townhouses are to be two and three bedroom <br />modeled after Student Condos in Bloomington. Motion was made by Commissioner Pygman, <br />second by Commissioner Marshall to recommend to the Town Council to deny this request for <br />rezone. Vote was 4-2. Five votes were needed for motion to carry. Motion was made by <br />Commissioner McGuire, a second was not forthcoming, to recommend to the Town Council to <br />rezone to R-3. This petition is tabled to the April 22, 1999 meeting with no new notices <br />required. <br /> <br />Mr. Holloway showed the preliminary plat that was given to the Tech committee for Morgan's <br />Hideaway on Rooker Road. This one added greenspace,with no vegetation removal or soil <br />interruptions. <br /> <br />Tech committee: Now 274 lots instead of 278 lots. <br />1. 2 ½ to 1 width to depth ratio, approximately 50 lots exceed this--slope severely. Mr. <br />Holloway said they could make every lot meet this ratio. <br />2. Morgan Co. Highway permit for access onto Rooker Rd.-Holloway had letter from County <br />saying Commissioners have never turned down a road that met the necessary requirements. <br />3. Source of Title-Holloway said will provide <br />4. Street names--Mr. Holloway said not on preliminary plat but have given sizes of the streets <br />which include 50 foot radius on the Cul-de-sacs. <br />Mr. Holloway stated plans and specs will be provided before final plat approval. Complete <br />construction and sanitary plans meeting standards will be provided. There will be 40 lots in a <br />phase and 8 phases. A Certification of Deed for dedication for Public Street to the County at <br />time of Final Plat approval. Sewer permits and easements would be obtained before final plat <br />approval. Hill Water has commited to water service, and Chris Crouch has commited to sanitary <br />service. Commissioner McGuire stated his concern that intent was not to have 1/4 to ½ of the lot <br />size going down into a lake. Commissioner Young said the common area was basically flood <br />plain and they have maximized every possible use of ground in lots. He asked for a PUD. Mr. <br />Holloway said he would have to speak with his clients The attorney for the surrounding <br />residents asked if this addition was for manufactured housing. Mr. Holloway said will answer at <br />next meeting. <br /> <br />Mr. Holloway then presented a request from Jerome Diehl for a 2 lot minor plat on Rooker Road <br />consisting of 44 acres. Tech notes: 1. no location map <br /> 2. Barn obstructs access <br /> 3. does not address prior separation <br /> <br />Huntington Bank had sold off 14.5 acres of parcel to Sherman Rash without a survey showing <br />division of property. Commissioner McGuire commended Building Inspector Joe Beikman for <br />catching this problem before issuing a building permit. He doesn't think Plan Commission <br />should get into the middle of this problem, that Huntington Bank should make it right. Jerome <br />Diehl said he would like to keep the barn if possible. Attorney Tim Currens said access is there <br />just would have to steer around the barn. Mr. Diehl wants to build two homes, one for him and <br /> <br /> <br />
