MOORESVILLE BOARD OF ZONING APPEALS <br /> MINUTES <br /> MAY 13, 2004 <br /> <br />The Mooresville Board of Zoning Appeals met on May 13, 2004 at 7:00 P.M. at the Mooresville <br />Town Hall. <br /> <br />Members present were: Alan Kramer, Chairman, Don Barry, Mike Young and Christopher <br />Crouch. Jonathan Swisher was absent. Town Attorney, Tim Currens, was present. <br /> <br />Motion to approve the minutes of the April 8th meeting was made by Don Barry, second by <br />Christopher Crouch. Motion carded 4-0 <br /> <br />First on the agenda was Dale Coffey, Holloway Engineering, representing Ed Bartley, asking for <br />a variance from development standards for a billboard structure on property located on the <br />northeast comer of High Street and State Road 144. It will be a single pole structure thirty-five <br />feet high, with a four-sided billboard. Mr. Bartley has already obtained a state permit for a sign <br />at that location and has state approval for a four-sided billboard. The property is very narrow <br />with limited access and currently there are no structures. They do not believe that placing a sign <br />in this location would adversely affect any sight views or safety concerns. So they are asking ' <br />for a variance from development standards for this structure, which will be 35 feet in height, and <br />will be 10 V2 feet by 36 feet for each sign on all sides. Mr. Barry asked if each sign would be <br />about 370 square feet and Mr. Coffey said that was correct. Mr. Barry asked what the structure <br />would be made out of and Mr. Coffey said the structure would be steel, with signage being vinyl. <br />Mr. Barry said that each sign is three times larger than the ordinance allows and it does not meet <br />the setback requirements. Mr. Crouch asked if the sign would be illuminated and Mr. Coffey <br />said it would. Mr. Currens asked what the current zoning was for the property and Mr. Remster, <br />the property owner, said it was B-2. Mr. Kramer asked if there was a 24-V2 feet clearance from <br />the ground to the base of the signs and Mr. Coffey said that was correct. Mr. Young said the <br />variance request was for height and square footage of the sign, but actually what you are looking <br />at is it is not an allowed use in a B-2 district, it is within 500 feet of two state highways./ <br />intersecting, within 500 feet of a park, the maximum square footage per sign, and has more than <br />two faces on the sign. Mr. Crouch asked how they would address the city owned park to waive <br />the setback and Mr. Currens said they would have to apply to the Park Board for a waiver. Mr. <br />Coffey asked for a continuance until next month so they can file an amended petition asking for <br />variance of use and from development standards. <br /> <br />Motion to table the request for a variance of development standards of advertising structure at <br />the comer of High Street and State Road 67 until June meeting was made by Mr. Young and <br />second by Mr. Barry. Motion carded 4-0. <br /> <br /> Next was Mr. Dale Coffey, Holloway Engineering, representing Mr. Ed Bartley, requesting a <br /> variance from development standards for a two-sided billboard on Lot 4-H at Southbridge <br /> Crossing. This billboard would set on the back of the building known as GT Collision, which <br /> sets on Lot 4-H. They are requesting a variance from development standards for height and <br /> square footage. It will be a single pole structure 45 feet in height from the ground to the top of <br /> <br /> <br />
