May 10, 1990 <br /> <br /> The Mooresville Town Council met in emergency session, which <br /> was mandated by Judge Gray, on May 10 1990 at 5:30 p m at the <br /> Mooresville Town Hall. ' ' ' <br /> <br /> Council members present were Dick Heald, Pat Overholser, Steve <br /> Ballard, Jack Forbes, and Steve Edwards No council members were <br /> absent. · <br /> <br /> Council Attorney Tim Currens advised the Council that this <br /> meeting was necessitated in order for the Council to answer the <br /> request for omission as follows: <br /> <br /> 1. Mooresville Town Council on April 3, 1990 <br /> adopted Resolution 2, 1990 Approving An <br /> Order of the Mooresville Plan Commission <br /> a Certain Declaratory Resolution and Re- <br /> development Plan Adopted by the town of <br /> Mooresville Redevelopment Commission. <br /> <br /> 2. Mooresville Town Council on April 3, 1990 <br /> Adopted Resolution 2, 1990 which approved <br /> the Plan Commission order which was adopted <br /> March 22, 1990. <br /> <br /> 3. The Town Council used the proposed Comprehensive <br /> Plan as one of several factors relied upon in this <br /> matter. <br /> <br /> 4. The Town Council hasn't approved the Compre- <br /> hensive Plan which is proposed. <br /> <br /> Motion was made by Councilman Heald and second by Council- <br />woman Overholser to allow Council Attorney Currens to answer the <br />request for omissions. Motion carried unanimously. <br /> <br /> Motion was made by Councilwoman Overholser and second by <br />Councilman Forbes to allow Town Attorney Currens to defend the <br />council in the impending lawsuit which has been brought against <br />the town. Motion carried unanimously. <br /> <br /> There being no further business to come begore the Mooresville <br />Town Council at this time Councilman Heald made a motion to adjourn <br />the emergency session of the Mooresville Town Council, Councilman <br />Ballard second.
