May 10, 1990 The Mooresville Town Council met in emergency session, which was mandated by Judge Gray, on May 10 1990 at 5:30 p m at the Mooresville Town Hall. ' ' ' Council members present were Dick Heald, Pat Overholser, Steve Ballard, Jack Forbes, and Steve Edwards No council members were absent. · Council Attorney Tim Currens advised the Council that this meeting was necessitated in order for the Council to answer the request for omission as follows: 1. Mooresville Town Council on April 3, 1990 adopted Resolution 2, 1990 Approving An Order of the Mooresville Plan Commission a Certain Declaratory Resolution and Re- development Plan Adopted by the town of Mooresville Redevelopment Commission. 2. Mooresville Town Council on April 3, 1990 Adopted Resolution 2, 1990 which approved the Plan Commission order which was adopted March 22, 1990. 3. The Town Council used the proposed Comprehensive Plan as one of several factors relied upon in this matter. 4. The Town Council hasn't approved the Compre- hensive Plan which is proposed. Motion was made by Councilman Heald and second by Council- woman Overholser to allow Council Attorney Currens to answer the request for omissions. Motion carried unanimously. Motion was made by Councilwoman Overholser and second by Councilman Forbes to allow Town Attorney Currens to defend the council in the impending lawsuit which has been brought against the town. Motion carried unanimously. There being no further business to come begore the Mooresville Town Council at this time Councilman Heald made a motion to adjourn the emergency session of the Mooresville Town Council, Councilman Ballard second. Motion carried unanimously. No council members were absent.
