212 <br /> <br /> Numerous property owners from BoYdHeights attended the Moores~illeCouncil <br /> meeting in regard to the Town of Mooresville exte~lding the Town's <br /> sewer system to this subdivision. <br /> <br /> Town attorney Tim Currens providedeach BoydHeights property owner in <br /> attendence a Request to Extend the Town Sanitary Sewer and Waiver <br /> of Annexation agreement. Mr. Currens advised those present that <br /> it will be necessary for the property owners in Boyd Heights <br /> to consent to this agreement and return executed copies of this <br /> agreement to the Mooresville Town Council to enable further <br /> action to be taken on this matter. <br /> <br /> The following bids for mowing the Town Cemeteries were <br /> opened: <br /> <br /> M & S lawn Care $600.00 per mowing cemetery <br /> $200.00 per mowing extra field <br /> <br /> Pitman Mowing $650.00 per mowing cemetery <br /> $250.00 per mowing extra field <br /> <br /> Smith & Sons lawn Care $600.00 per mowing cemetery <br /> $150.00 per mowing extra field <br /> <br /> The bids will be reviewed by Cemetery Sexton Ed Bucker and <br /> awarded at the April 5, 1994 Town Council meeting. <br /> <br /> Motion was made by Councilman Viles, second by Councilman <br /> Edwards to release $23,698.13 from Environmental Development <br /> Corporation Escrow Account. Motion carried unanimously. <br /> <br /> Motion was made by Councilman Heald, second by Councilman <br /> Viles to approve Independent Appraisals contract to appraise <br /> town property for insurance purposes. Motion carried unanimously. <br /> <br /> Motion was made by Councilman Ballard, second by Councilman <br /> Heald to approve the radio dispatch contracts between the Town <br /> and Brown Township Volunteer Fire Department, Brown Township life <br /> Star, Madison Township Volunteer Fire Department. <br /> Motion carried unanimously. <br /> <br /> Town attorney Tim Currens presented Ordinance #3-1994 An <br /> Ordinance To Rezone 78.359 acres located on Rooker Road from <br /> agriculture to PUD - R. <br /> <br /> Ms. Nora Carroll, 1350 Rooker Road appeared before the Council <br /> questioning the quality of homes which will be constructed in <br /> this subdivision. Town attorney Currens explained to Ms. Carroll <br /> that the Town followed state building codes in approving construction <br /> of buildings in the Town's zoning jurisdiction and has no <br /> authority to mandate more than is mandated by state building codes. <br /> <br /> Councilman Viles inquired about the traffic flow in the area <br /> of this development. Town attorney Currens explained that Rooker <br /> Road is a county road and State Road 144 is a state highway and <br /> the Town has no jurisdiction on these roads. <br /> <br /> Motion was made by Councilman Ballard, second by Councilman <br /> Heald to approve Ordinance #3-1994 An Ordinance Rezoning land <br /> Within the Town of Mooresville Upon the Application of Environmental <br /> Development Corporation. Motion carried 3-1-1. Councilman <br /> Heald voted yes, Councilman Ballard voted yes. Councilwoman <br /> Overholser voted yes. Councilman Viles voted no. Councilman <br /> Edwards abstained. <br /> <br /> Town attorney Tim Currens presented Ordinance #4-1994 An <br /> Ordinance To Rezone 41.643 acres located on Iandersdale Road <br /> from agriculture to PUD - R. <br /> <br /> <br />
