You mean this here is just shown as one lot. Right, fight now he owns 12 acres which includes <br />Lot 1, 2 and 3. This really hasn't been recorded and platted yet. We got approval by the Plan <br />Commission but we haven't got the Plat signed or recorded, so presently as it stands he owns <br />12 acres of B-2 ground with one building on it and that was the basis of his permit being issued, <br />one building on that 12 acres so that if any other construction would take place he would have <br />to record the Plat or amend it or whatever different configuration would happen there. What <br />was it we did last time? That was something entirely different. It's the same piece of property <br />on Lot 2 right with the depth. Right. That was the variance for the Plat. It was required for <br />the Plat if he chose to record it Tom and that was one of the requirements of the Plan <br />Commission for approval of that Plat. So when I say it's unrelated, it's unrelated to what they <br />are requesting this evening on those setbacks. Good questions, that's how that came about. <br />They had gone to the Plan Commission for the Plat approval and in the Plat that was one of the <br />things tnat did not need our Ordinance requirements. They had come forth this evening to ask <br />for a variance from the development standard. Does the Board have any other questions? I <br />might make one additional comment. I think that with the B-2 zoning and the open area that <br />you've got here being along a large commercial highway the size restrictions for B-2 would <br />really be inappropriate for this location and would really be a hindrance for the fast food <br />establishment and certainly considering that we have signs larger than that right down the street <br />from us what basically could be considered a B-2 area I don't think that this would be an undue <br />hardship certainly not a hinderance on any of the surrounding property values or anything else. <br />In fact, I believe right across the street we've got a Mooresville Savings Bank sign that is <br />approximately the same size. I did not measure it. Any comments from the floor? I might <br />make one comment for the Board just for their information - the square footage I show there is <br /> <br /> <br />
