MOORESVILLE BOARD OF ZONING APPEALS
FINDINGS OF FACT

Comes now the Mooresville Board of Zoning Appeals and pursuant to the evidence
presented at the public hearing held November 15, 1995 reviewed the petition filed by Arvin
Hopkins, Roger Caperton and Don Stafford on Karrington Estates requesting a variance from
the development standards for Lots 24-28 inclusive and Lots 43 and 44 on the width to depth
ratio and the Board now makes the following Findings of Fact pursuant to IC 36-7-4-918.5:

1. That the approval will not be injurious to the public health, safety, morals and general
welfare of the community due to the lay out of the lots in this subdivision;

2. The use and value of the area adjacent to the property included in the variance will
not be affected in a substantially adverse manner due to the lay out of the subdivision;

3. The strict application of the terms of the Zoning Ordinance would result in practical
difficulties in the use of the properties pursuant to the subdivision's lay out.

This variance request granted this 15th day of November, 1995 upon the aforementioned
Lots concerning, width to depth ratio requiremen~ ~/~/--c--~"~'--'~~7~~ ~

/
Presi~er~t
