MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> Comes now the Mooresville Board of Zoning Appeals and pursuant to the evidence <br />presented at the public heating held November 15, 1995 reviewed the petition filed by Best <br />Homes, Inc. requesting a sign on SR 67 in an A Agricultural District for a limited period of <br />time not to exceed two (2) years on the real property located on SR 144 and the Board not <br />makes the following Findings of Fact pursuant to IC 36-7-4-918.4: <br /> <br /> .1. That the approval will not be injurious to the public health, safety, morals and general <br />welfare of the community due to the location of the sign and the adjoining uses; <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner due to the limitation of the sign being in place <br />for only two (2) years; <br /> <br /> 3. The need for the variance arises from some condition peculiar to the property <br />involved in that it is an Agricultural Use surrounded by Residential Uses. <br /> <br /> 4. The strict applieation of the terms of the Zoning Ordinance would constitute an <br />unnecessary hardship if applied to the property for this specific type of variance. <br /> <br /> 5. The approval does not substantially interfere with the Comprehensive Plan due to the <br />nature of surrounding uses. <br /> <br /> The Mooresville Board of Zoning Appeals grants a two (2) year variance from the date <br /> of November 15, 1995 through November 14, 1997 to Best Homes, Inc. to place a sign on SR <br /> 67 in an Agriculturally zoned district. <br /> <br /> ,~S~ecret~- ,' - ~- <br /> <br /> (This sign is to be placed pursuant to the petition and drawings accompanying the variance <br /> request.) <br /> <br /> <br />
