MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> Comes now the Mooresville Board of Zoning Appeals and pursuant to the evidence <br />presented at the public hearing held November 15, 1995 reviewed the petition filed by Best <br />Homes, Inc. requesting a variance from use ordinance to allow an advertising structure on <br />property zoned A Agricultural District for a limited period of time not to exceed two (2) years <br />on the real property located on SR 144 and the Board not makes the following Findings of Fact <br />pursuant to IC 36-7-4-918.4: <br /> <br /> 1. That the approval would be injurious to the public health, safety, morals and general <br />welfare of the community due to the location of the sign in proximity to residential uses; <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance would <br />be affected in a substantially adverse manner due to the residential uses being very close in <br />proximity to the sign; <br /> <br /> 3. The need for the variance does not arise from some condition peculiar to the property <br />involved. <br /> <br /> 4. The strict application of the terms of the Zoning Ordinance will constitute an <br />unnecessary hardship if applied to the property for which the variance is sought for any type of <br />sign usage. <br /> <br /> 5. The approval does not substantially interfere with the Comprehensive Plan. <br /> <br /> Based upon the Findings of Fact, the Mooresville Board of Zoning Appeals denies the <br /> variance request this 15th day of November, <br /> <br /> President ~ . .~..-~ ( ] <br /> <br /> <br />
