S <br />The next meeting of the Mooresville Town Council will be on Wednesday, January 2nd,. 200$, at 6:30 P. Perry, Clerk-Treasurer <J <br />~~] <br />January 2, 200$ <br />The Mooresville Tawn Council met on Wednesday, January 2, 2008, at 6:30 P. M. at the Mooresville <br />Government Center. <br />Council members present were: Mark Harris, Jeff Cook, Jahn L. Clark, Ryan Goodwin, and Tony Langley. <br />No members were absent. Tawn attorney Tim Currens was also present: <br />Jeff Newton, Free Methodist Church, gave the prayer <br />A motion was made by Councilman Clark with a second by Councilman Goodwin to approve the minutes <br />of December 18, 2007. Motion carried 5~0. <br />Councilman Clark nominated Mark Harris for Town Council President and Councilman Cook seconded the <br />noznination_ There being no further nominations, Mark Harris was voted in as Town Cauncil President S-0. <br />y Atwood. appeared before the Cauncil with mare questions concerning the ditch behind her home an <br />ring Mill Drive. Judy asked about there being a ditch in the beginning, then a Swale, and now a ditch <br />again. What was done to prevent erosion to occur fifteen years later, and what the vegetation the first <br />five homes had on prevention of erosion. She said she doesn't understand being told there was no extra <br />water taming dawn the ditch that started happening in 1992. The homeowners were starting to question <br />why. <br />Council President, Mark Harris, told Mrs. Atwood that at the last meeting she had promised litigation, so <br />he was turning the questions over to Attorney Currens. Judy asked, didn't the Town give approval for <br />drainage far Rooker Trace and Rooker Run? Judy's sister, Kay Angel, 101 S. Letterman Rd., Paragon, hi <br />stated three engineers have been involved and asked how much longer the Town needed to talk to <br />Someone? Attorney Currens told her ante the Town received the report an what was found, they gave a <br />report at the last meeting. They found nothing other than sandy type of sail and lack of maintenance on <br />the Swale and now a ditch. Mr. Haggard from Banning Engineering gave the report. Judy stated that all <br />along information was given to the engineers and nothing was mentioned to her about there being a ditch <br />and then turned into a Swale all along. Brian Haggard said his understanding was the first five Tats were <br />maintained to keep the existing channel intact. His findings did not find the water had increased. The <br />north line of Rooker should be a drainage pipe from`the street and drains down into a little basin and that <br />does not have to be noted on a plat. Attorney Currens said if the homeowners had netted and stoned then <br />this would have been a different story. <br />z: v~ <br />Shields, former council member, gave his information on technology far the town to Councilman <br />odwin. <br />A motion was made by Councilman Clark with a second by Councilman Goodwin to sign the contract for <br />Attorney Currens, $175.00 an hour which is an increase of $5.00 an hour from last year. Motion carried <br />S-0. <br />A motion was made by Councilman Clark with a second by Councilman Goodwin to enter into an <br />easement agreement for the Kurkowski property and to have Banning Engineering to obtain the legal <br />
