MINUTES OF THE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met for its regular
meeting on Wednesday, November 2~, 1990, at 7:00 p.m. at the
Mooresville Town Hall. Present were Board Members Don Barry, Vern
Kimmel, Alan Kramer, and Robert Tucker. The Board's Attorney,
Timothy C. Currens, was also present. Chairman Barry determined
there was a quorum present and proceeded with approval of the
minutes of the prior meeting.

The first item on the agenda was the request by David E.
Neathery concerning the property at the southeast corner of Bridge
Street and Highway 67, requesting a variance from the development
standards for a sign set-back from 60 feet to 30 feet and a canopy
extending from the service station front from 40 feet to 38 feet.
Drawings were presented and the Board proceeded with a discussion.
Bob Tucker asked why the sign could not be moved south.

Roger Caperton, who was present for Mr. Neathery, advised that
there was a drainage ditch which would put the sign down in a hole
and in a less solid base. The drawings were reviewed and it was
determined that the canopy might well be within the 40 foot set-
back area; however, the representative of the petitioner advised
that these were prefabricated buildings and could not be changed
so the variance was being requested. The Board then proceeded to
findings of fact on the canopy set-back variance from 40 foot to
38 feet. The Board found the following:

1. That the approval would not be injurious to the public
health, safety, morals and general welfare of the community
due to the location of this property and the insignificant
set-back variance.
