MINUTES OF THE MOORESVILLE <br /> BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its <br />meeting place at the Mooresville Town Hall the 20th day <br />1988. Present were board members Steve Oschman, Robert <br /> <br />regular <br />of July, <br />Tucker, <br /> <br />Tilford Bailey, Don Barry and Warren Franklin. <br />attorney, Timothy C. Currens, was also present. <br />proceeded to determine a quorum was present and <br /> <br />The board's <br />The board <br />approved the <br /> <br />minutes of the prior meeting and findings of fact. <br /> <br /> The first item to come before the board was the special <br />exception request of Leonard Deckard on the property located at <br />992 South State Road 67. The board acknowledged receipt of notice <br />from the Mooresville Plan Commission, which made a determination <br />that the proposed special exception would not adversely affect the <br />Master Land Use Plan. Ros Stovall was present for Mr. Deckard and <br />gave a brief statement of facts. The board then proceeded to <br />findings of fact for a special exception, having a discussion on <br />the following: <br /> <br /> 1. That the establishment, maintenance, or operation of the <br />special exception would not be detrimental to or endanger the <br />public health, safety, morals, or general welfare due to its <br />location on property adjoining a four-lane highway and other uses <br /> <br />in the area. <br /> <br /> 2. That the <br />use and enjoyment <br /> <br />special exception would not be injurious to the <br />of other properties in the immediate vicinity <br />for the purposes already permitted, due to the nature of the <br />adjoining businesses, which includes Swinney Excavating, the <br /> <br /> <br />
