MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS The Mooresville Board of Zoning Appeals met at its regularly called session on Wednesday, the 20th day of June, 1984, at 7:00 o'clock P.M. at the Mooresville Town Hall. Present were Board Members Wendell Thaler, Paul Walters, Tilford Bailey, Warren Franklin and Chairman Steve Oschman. The Board's Attorney, Timothy C. Currens, was also present. A determination of a quorum was made by Chairman Oschman and the minutes of the last meeting were approved as read by all members. Chairman Oschman then proceeded to the first item on the agenda, an application for special exception to permit the applicants to remove top soil from a part of the acreage described in the legal description representing 11½ acre tract and a special exception requesting permission to remove sand and gravel from a part of the 90 acre tract in the area shown on attached Exhibit "B" and lastly, for a request to use the 90 acre tract for a business enterprise of a recreational lake upon completion of the removal of the topsoil amd mineral deposits. This petition was filed by Harry F. Tidler and Deloris A. Tidler, Robert Burdin and Geraldine A. Burdin, the owners of the property. Attorney Currens advised the Board that the legal notices were in order and further that pursuant to Chapter 5 of the Town Zoning Ordinance, "Special Exception Procedures", that the Plan Commission had made a finding that the proposed special exception use would not adversely affect the Master Land Use Plan. Mr. Tidler was present along with his attorney, David Lawson, from Danville, Indiana. Mr. Lawson proceeded with a presentation giving a history of the ownership of the property by the Tidlers and Burdins over approximately 10 years and that it was purchased originally from the Mooresville Development Company who had a planned industrial park in that area.
