MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly called <br /> <br />session on Wednesday, the 20th day of June, 1984, at 7:00 o'clock P.M. at <br />the Mooresville Town Hall. Present were Board Members Wendell Thaler, Paul <br />Walters, Tilford Bailey, Warren Franklin and Chairman Steve Oschman. The <br />Board's Attorney, Timothy C. Currens, was also present. A determination of <br />a quorum was made by Chairman Oschman and the minutes of the last meeting were <br />approved as read by all members. <br /> <br /> Chairman Oschman then proceeded to the first item on the agenda, an <br />application for special exception to permit the applicants to remove top soil <br />from a part of the acreage described in the legal description representing 11½ <br />acre tract and a special exception requesting permission to remove sand and gravel <br />from a part of the 90 acre tract in the area shown on attached Exhibit "B" and <br />lastly, for a request to use the 90 acre tract for a business enterprise of <br />a recreational lake upon completion of the removal of the topsoil amd mineral <br />deposits. This petition was filed by Harry F. Tidler and Deloris A. Tidler, <br />Robert Burdin and Geraldine A. Burdin, the owners of the property. Attorney <br />Currens advised the Board that the legal notices were in order and further that <br />pursuant to Chapter 5 of the Town Zoning Ordinance, "Special Exception Procedures", <br />that the Plan Commission had made a finding that the proposed special exception <br />use would not adversely affect the Master Land Use Plan. Mr. Tidler was present <br />along with his attorney, David Lawson, from Danville, Indiana. Mr. Lawson proceeded <br />with a presentation giving a history of the ownership of the property by the <br /> <br /> Tidlers and Burdins over approximately 10 years and that it was purchased originally <br /> from the Mooresville Development Company who had a planned industrial park in that <br /> area.
