MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly <br />scheduled meeting the 19th day of December, 1984 at the Mooresville <br />Town Hall. Present were Chairman Steve Oschman, and Board Members <br />Tilford Bailey, Warren Franklin, Wendell Thaler, and Paul Walters. <br />Present on behalf of Board Attorney Timothy C. Currens was Attorney <br />Michael A. Ksenak. Chairman Steve Oschman determined that there was a <br />quorum and opened the meeting. The minutes of the prior meeting were <br />approved. <br /> <br /> Finding no business from the floor or old business, the Board proceeded <br />with new business. The only application to come before the Board was the <br />application for a special exception or in the alternative a variance to <br />allow the petitioner to place upon the real estate located at 745 North <br />Indiana Street a mobile home for a maximum period of five (5) years for <br />the use and benefit of R. Alan McConnell as a temporary residential home. <br />Petitioner was represented by Attorney David Lawson of the firm HOWARD, <br />LAWSON & LOWRY, Danville, Indiana. Mr. Lawson stated that he felt that <br />the variance procedure was better suited for the specifics of this case <br />than the special exception procedure in that the request does not fit <br />within the occupancy definitions set forth under Section 3.5 of the Zoning <br />Ordinance of Mooresville, Indiana. ~. Lawson indicated that the request <br />was limited to not more than five (5) years and that by or before that <br />date, that Mr. McConnell intended to have a home built on that property. <br />He further stated that they would be in compliance with all Morgan County <br />requirements for a septic system and further that the mobile home would <br />not be lived in until any and all Board of Health regulations were met. <br /> <br /> <br />
