MINUTES OF MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at a specially called session <br />on Wednesday, the llth day of May, 1983 at 7:00 o'clock P.M. at the Mooresviile <br />Town Hall. Present were Board Members Steve Oschman, Nan Kollmeyer, Warren <br />Franklin and Paul Walters. The Board's Attorney, Tim Currens was also present. <br />The meeting was called to order by Chairman Steve Oschman and the minutes of <br />the last meeting were approved by all members. Determination of the quorum <br />was made and the Board proceeded to the first item of business, zoning appeals <br />docket number 2-1983, a petition for a variance filed by Judy Arterberry of <br />Smith Brothers Builders and Supply, Inc. on behalf of Larry Tooley, 560 Maple <br />Lane, Mooresville, Indiana requesting a variance of allowance of a two foot <br />south property line set-back from a proposed garage. The property was currently <br />zoned single family dwelling. Board Attorney advised that all property notices <br />sent by registered letter had been properly signed with the exception of a <br />returned letter from Herman W. Coffey who was the next door neighbor to said <br />property line. Petitioners advised that the address for Mr. Coffey was the <br />address given at the Auditor's Office in the Morgan County Courthouse. There <br />were no questions from the floor and after examination by the Board as to the <br />details of said variance, Paul Walters then proceeded to make the following <br />findings: <br /> <br /> 1. That there are exceptional and extraordinary <br /> circumstances or conditions applicable to the <br /> property of the petitioners and to the intended <br /> use that does not apply generally to the other <br /> property or class of use in the same vicinity <br /> and in the district in which it is located. <br /> <br /> <br />
