MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met at a specially called session

on Wednesday, the 5th of October, 1983, at 7:00 o'clock P.M. at the Mooresville
Town Hall. Present were Board Members Steve Oschman, Paul Walters, Ray House,
Warren Franklin, Wendell Thaler and Nan Kollmeyer. Also present was the Board's
Attorney Timothy C. Currens. The meeting was called to order by Chairman Steve
Oschman and the minutes of the last meeting were approved by all members. There
was a determination of a quorum and the Board proceeded with Case Number 6-1983
a variance filed by Walter Hadley and Minnie J. Hadley to allow for the assembly
of pre-cut pieces of lumber and to make and sell bunk beds and other hobby wood
projects in their home. Present were Mr. Hadley and his attorney, Thomas Kough.
Mr. Kough proceeded to explain to the Board the variance request and use of the
property. Primarily that at this time Mr. Hadley had a 2' x 4' sign in their
front yard advertising his bunk beds for sale and that he had one constructed
bunk bed on the front porch of the house for display. Mr. Hadley would be using
the car port during the summer months for some of the assembly work and that there
would only be limited storage of materials, all of which would be inside. He
further advised that no traffic problem was created in that only one customer
would normally appear and that it was merely a supplemental income hobby for
a retired individual.

The Board questioned Mr. Hadley as to storage, traffic, location and use

of said property. Chairman Oschman then opened the questioning up to remonstrators.
Speaking first was Mr. David Kollmeyer of 20 West Street, Mooresville, Indiana.

Mr. Kollmeyer then explained his location to Mr. Hadley's property and his objections
which consisted of the sign on the premises in a residential area and the distractions
