MM <br />July 3, 2018 <br />The Mooresville Town Council met in regular session on Tuesday, July 3, 2018, at 6:30 P. M. at the <br />Mooresville Government Center. <br />Town Council members present were: President Tom Warthen, Vice -President David Rogers, Joe <br />Beikman, Dustin Stanley, and Mark Mathis. No members were absent. Town attorney Mel Daniels was <br />present. <br />Tom Warthen gave the prayer. <br />A motion was made by Councilman Rogers with a second by Councilman Stanley to approve minutes <br />from June 19th meeting. Motion carried 4-0-1 abstention, Council President Warthen was absent at that <br />meeting. <br />New Business: Council President Warthen wants to amend agenda to add install cameras thru out the <br />Wastewater Plant. Motion was made by Councilman Mathis with a second by Councilman Rogers to <br />approve. Motion carried 5-0. <br />Councilman Mathis announced the Town was close to going live on the Website. For $15,000 more <br />Phase 2 will be completed. This is for streaming and more on the Police and Fire portion such as forms. <br />A motion was made by Councilman Mathis with a second by Councilman Rogers to approve. Motion <br />carried 5-0. <br />Next: Shane Williams -annexation in to Town for his property at 400 Northridge Drive. <br />Council President Warthen reported that on GIS there are three properties owned by him showing a <br />driveway going across two properties and it goes in town and out of town. Council President Warthen <br />asked Shane if he would entertain annexing all three parcels. Councilman Beikman said he would like to <br />see all three parcels and the old Dillenger farm annexed. Shane said he couldn't answer for the <br />Dillenger farm but he didn't see a problem with annexing all three parcels for him. <br />A motion was made by Councilman Beikman with a second by Councilman Mathis to approve an impact <br />study on the parcels. Motion carried 5-0. <br />Brent Callahan -Street Closing Permit for July 14, 2018 concert: <br />The Jennie DeVoe concert is July 14th and the Park doesn't have an estimate on how many people to <br />expect in downtown Mooresville. The permit is for closing North Indiana Street and East Main Street. <br />The department heads involved have a meeting on Monday, July 9th at 9 AM to discuss the event and <br />possibility of having a back-up plan to close South Indiana Street and West Main Street. Councilman <br />Mathis said leave it to Department heads at Monday's meeting to decide what can be done. <br />A motion was made by Councilman Rogers with a second by Councilman Stanley to allow the <br />Department Heads to work together on an area closing. Motion carried 5-0. <br />Unfinished Business: Keswick Estates- escrow account. <br />Kathy Crockett and Laurie Patel, sisters and daughters of Fred and Margie Wyttenback began handing <br />out more information on themselves and on county statutes. Town attorney Mel Daniel asked them to <br />please hold up and sit down because he had something he wanted to say. Attorney Daniel went thru a <br />time line of events. On December 20, 2001 the Plan Commission approved Keswick Estates conditional <br />upon a bond or escrow agreement of $27,000. On April 181h, 2002 and June 27,2002, Mike Young, <br />Chairman of Plan Commission signed the agreement. The sisters said their concerned was it looked like <br />the signatures were falsified because they looked exactly alike and that could not be. The $27,000 was <br />put in a Business checking account which didn't draw interest so the Wyttenbachs could write checks <br />when the work was completed. The terms of the agreement never changed. In 2009 the Wyttenbach's <br />asked for the plat to be vacated and replatted, nothing was said about the $27,000. Years passed and <br />the sisters appeared wanting the money released. The council gave them an agreement to sign to get <br />the $27,000 for them. The sisters counter -offered wanting $125,342.58. They had calculated 9 1/2% <br />interest on $27,000 over the sixteen years to come up with this amount. The difference was $88,342.58 <br />of which there was an extra $10,000 thrown in. The only thing the Wyttenbachs had done with the <br />property was to put water utilities in easements. Since some utilities were put in with Plan Commission <br />approval, the statute requires the Plan Commission to approve vacating the plat. The agreement Mr. <br />Daniel had for the sisters to sign tonight was the same as before, $27,000 reimbursed to them and the <br />
