April 7, 2020 <br />The Mooresville Town Council met in regular session on Tuesday, April 7th at 6:30 P. M. at the <br />Mooresville Government Center. <br />Police Chief Kevin Jilian gave the prayer. <br />Council members physically present were, Council President Shane Williams, Councilman Tom <br />Warthen. Councilwoman Jessica Hester, Councilman Dustin Stanley, and Councilman Jeff Cook <br />a <br />were present via telephone. Town attorney Chou-il Lee was present via telephone. <br />Motion was made by Councilman Warthen to approve the minutes of the March 17th' meeting <br />and seconded by Councilwoman Hester Motion Carried 5-0 <br />Motion was made by Councilman Warthen to approve the minutes of the March 201h Special <br />Meeting and seconded by Councilman Stanley Motion Carried 5-0 <br />Unfinished Business —None <br />New Business— <br />Introduction of Sewage Works Rate Ordinance —Adam Steuerwald from Barnes & Thornburg <br />LLP addressed the council about adopting rates for the Sewer Ordinance. He suggested the <br />option of a Bond Anticipation Note that would provide the funding needed while delaying the <br />rate changes until 2021, and delaying the bonds temporarily. The council was presented with <br />the options of only funding phase one now, or funding both phase one and phase two with this <br />Rate Ordinance. There was a discussion on the benefits and the options of the length of the <br />BAN. <br />Council President Williams brought up the fact that some residents had addressed the council <br />about sewer rates that would affect customers that used water for things like filling pools and <br />irrigation where the water did not go back through the sewer system yet they were getting <br />billed for the sewer usage. Scott Miller with Bakertilly addressed the fact that this increase was <br />based upon making sure that the maintenance and upgrades would be able to be covered with <br />a little of an increase as possible. If thing like this were to be factored in now it could lead to a <br />substantial increase in the overall rates. While the ordinance does not specifically address <br />those particular issues, town attorney Chou-il Lee said that there is a possibility to change the <br />rate at a later date. <br />Councilman Warthen made a motion to attempt to achieve a bond anticipation note for 2 <br />years callable in 12 months. The motion was seconded by Councilman Cook. Motion carried 5-0 <br />Councilman Warthen made a motion to approve the first reading of Ordinance 5-2020 fully <br />funding phases one and two of the sewer improvement project. Councilman Stanley seconded <br />the motion. Motion carried 5-0 <br />There will be a public hearing on this ordinance at the next council meeting. Adam Steuerwald <br />with Barnes & Thornburg suggested that the ordinance be updated to state that the usage rate <br />would be based on usage during January 2021, and would become effective February 2021 <br />billing. Councilman Warthen made a motion to update section 8 of the ordinance to reflect <br />these changes. Councilman Stanley seconded the motion. Motion carried 5-0. There will be a <br />public hearing on this ordinance at the April 211T council meeting <br />
