HEM <br />May 5, 2020 <br />The Mooresville Town Council met in regular session on Tuesday, May 5th at 6:30 P. M. at the <br />Mooresville Government Center. <br />Council members physically present were, Council President Shane Williams, Councilman Tom Warthen, <br />and Councilman Jeff Cook. Councilwoman Jessica Hester and Councilman Dustin Stanley were present <br />via telephone. Town attorney Chou-il Lee was present. <br />Councilman Warthen gave the prayer. <br />Motion was made by Councilman Warthen to approve the minutes and the exhibits of the April 21st <br />meeting and seconded by Councilman Cook Motion Carried 5-0 <br />Unfinished Business — <br />COVID-19 Update —Attorney Lee gave an update on the most recent executive orders issued by the <br />Governor. The electronic town council meetings can continue as is until June 8th. He also mentioned the <br />Federal CARES act municipal loans and how that may affect the Town of Mooresville specifically the <br />discrepancy in tax dollars that may occur for the first half of the year. Attorney Lee advised the Clerk <br />Treasurer Dianna Wamsley to work closely with the financial advisors so that if funds from the CARES act <br />are needed to ensure the needed funds are available for the Town the correct steps can be taken. A <br />short discussion occurred about the different options of financing, both internally and externally to <br />ensure the Town has the funds available to continue to operate should there be a shortfall due to the <br />COVID-19 Emergency. <br />Council President inquired about the reopening of the Government Center to the public and some of the <br />changes that have already been made were detailed. Town Attorney Lee let the council know that the <br />governor has amended his instructions to allow municipalities to determine the correct plan of action <br />for their communities and detailed the new social distancing criteria laid out by the State. Chief Julian <br />from the Police Department detailed his current plan for his personnel, and his plan going forward. <br />New Business— <br />Change Order for Government Center Roof and the Town Street Department Garage. Josh Smalling <br />presented himself before the Council to request a Change Order to allow for changes to the original <br />public works contract to replace roofs of the Government Center and the Street Department Garage and <br />to be able to work with the insurance company on a second claim. <br />Town Attorney Lee laid out the legal parameters for the changing of a public works contract. <br />It has come to light that the storm and subsequent tornado on April 81h caused additional damage to the <br />roofs that is requiring a change to the work set forth in the original contract. There was a lengthy <br />discussion on how to proceed on a change to this contract, as there is now a second claim on the roofs <br />due to the tornado. Councilman Cook made a motion to table this discussion until the next meeting in <br />an effort to be able to do more research into what may be needed to get this work done. Motion was <br />seconded by Councilman Warthen. Motion carried 5-0 <br />Department head reports— <br />Chief Julian from the Police department gave his report earlier in the meeting. Council President <br />Williams asked why the audio of a call between a dispatcher and Morgan County during the storm was <br />not included in the original report. Chief Julian stated that at the time he submitted the report he was <br />not aware of the existence of the recording. <br />Legal — none <br />Public Comments— None <br />A motion was made by Councilman Warthen with a second by Councilman Cook to approve claims in the <br />amount of $589,730.24 Motion Carried 5-0 <br />
