<br />~ <br /> <br />MOORESVILLE PLAN COMMISSION <br />MINUTES <br />OCTOBER 28, 1999, THURSDAY, 7:00 P. M. <br /> <br />The Mooresville Plan Commission met on Thursday, October 28,1999, at 7:00 P. M. at the <br />Mooresville Town Hall. <br /> <br />Plan Commission members present were: President Joel Beebe, Mike Young, John Ehrhart, <br />Alan Marshall, Charles McGuire, Tim Bennett, and Andy Pygman. Attorney Rod Bray was <br />present. No members were absent. <br /> <br />Motion was made by Commissioner Young, second by Commissioner Pygman to approve the <br />September meeting minutes. Motion carried 7-0. <br /> <br />President Beebe reminded Commission November's meeting would be following BZA meeting <br />on Wednesday, November 17,1999. Motion was made by Commissioner Young, second by <br />Commissioner Marshall to have December meeting of the Plan Commission to follow the BZA <br />meeting on Wednesday, December 15, 1999. Motion carried 7-0. <br /> <br />Attorney Dewayne O'Neal representing Morgans Hideaway asked the minutes include <br />Mooresville Zoning Ordinance, minutes and documents of April 22, 1999 and September 23, <br />1999 meetings. <br /> <br />Mark Waterfield representing C & M Utility reported seven homes connected at this time <br />running 166 gallon per day. He told Commission IDEM gave approval to add ninety-four more <br />homes by applying thru Indiana Regulatory ~mmission. Commissioner McGuire asked what <br />the usage capacity ofC & M was and said he thought the original approval was for 18 homes in <br />Chris Crouch's subdivision. Mr. Waterfield said at 310 gallons perday and 30,000 gallons <br />capacity, ninety-six homes could be on the system. Ross Holloway told the Commission the <br />amended plat was for eighty-five lots on 60.374 acres, zoned R-IA. He said the plat included <br />construction prints for 30,000 per day capacity, authority by State of Indiana to discharge in <br />tributary, and stated 30,000 gallons stays the same , number of homes can change. <br /> <br />Attorney O'Neal said IDEM would accept 180 homes and if you subtract 94 homes, 86 homes <br />could be served from this subdivision. Commissioner Pygman asked if it could be set up so the <br />plumbing was in back to the property instead of using the neighbor's property. Commission <br />McGuire said this unamed tributary was in a man's backyard. Attorney O'Neal said IDEM had <br />approved this tributary for discharge from the sanitary plant. ~ <br /> <br />Ross Holloway told the commission IDEM approved discharging across Mr. Kay's property to <br />White Lick Creek and he didn't think Plan Commission could overule IDEM. <br /> <br />Attorney Bray stated that by law, the Commission had an obligation to make sure the plant had a <br />Certificate of Authority and had capacity. If the Commission denies, they have to show some <br />
