<br />MOORESVILLE PLAN COMMISSION MINUTES <br />THURSDAY, SEPTEMBER 28, 1995 - 7:30 P.M. <br />MOORESVILLE TOWN HALL <br /> <br />The Mooresville Plan Commission met Thursday, <br />September 28, 1995 at 7:30 p.m. at the Mooresville Town Hall. <br /> <br />Commission members present were Bill Abbott, Charles <br />McGuire, Vern Kimmel, Mike Young, Art Raney, John Ehrhart, <br />Tim Bennett and Joel Beebe. Commission member Tim Cummins <br />was absent. <br /> <br />The minutes of the previous meeting were approved as <br />submitted. <br /> <br />The findings of fact from the August 24, 1995 meeting <br />were approved as submitted. <br /> <br />Mr. Phil Smith appeared before the Commission requesting <br />Harold and Jane Lloyd petitioning for a two (2) lot minor <br />plat located at 1062 Keller Hill Road. This parcel is part <br />of the SW/4 of Section 34, T14N R1E containing 7.469 acres <br />more or less. This is the petition which was presented at <br />the August 24, 1995 Plan Commission meeting which did not <br />receive a majority vote; therefore, petitioners are <br />requesting action on this petition at this time. <br /> <br />Mr. Smith explained that the Lloyd's petitioned the <br />Board of Zoning Appeals at the September meeting for a <br />variance on the 2 to 1 width to depth ratio on Lot 2 of this <br />minor plat. Mr. Smith advised the Plan Commission that the <br />Board of Zoning Appeals had no action taken on the variance. <br /> <br />Mr. Smith presented a written stipulation to the Plan <br />Commission stating that if the minor plat and variance which <br />is currently pending be approved, the Lloyd's will surrender <br />the existing variance for the additional residence upon Lot <br />1, and there would be only one residence on Lot 1 and one <br />residence on Lot 2 of this minor plat. <br /> <br />The stipulation presented to the Plan Commission is part <br />of these minutes. <br /> <br />Motion was made by Bill Abbott, second by Charles <br />McGuire to approve the Harold and Jane Lloyd two (2) lot <br />minor plat located at 1062 Keller Hill Road contingent upon <br />the Board of Zoning Appeals approval of a variance of width <br />to depth ratio on Lot 2 of the Lloyd minor plat. The vote <br />was deadlocked at 4 - 4. <br />
