MOORESVILLE PLAN COMMISSION MINUTES THURSDAY, SEPTEMBER 28, 1995 - 7:30 P.M. MOORESVILLE TOWN HALL The Mooresville Plan Commission met Thursday, September 28, 1995 at 7:30 p.m. at the Mooresville Town Hall. Commission members present were Bill Abbott, Charles McGuire, Vern Kimmel, Mike Young, Art Raney, John Ehrhart, Tim Bennett and Joel Beebe. Commission member Tim Cummins was absent. The minutes of the previous meeting were approved as submitted. The findings of fact from the August 24, 1995 meeting were approved as submitted. Mr. Phil Smith appeared before the Commission requesting Harold and Jane Lloyd petitioning for a two (2) lot minor plat located at 1062 Keller Hill Road. This parcel is part of the SW/4 of Section 34, T14N R1E containing 7.469 acres more or less. This is the petition which was presented at the August 24, 1995 Plan Commission meeting which did not receive a majority vote; therefore, petitioners are requesting action on this petition at this time. Mr. Smith explained that the Lloyd's petitioned the Board of Zoning Appeals at the September meeting for a variance on the 2 to 1 width to depth ratio on Lot 2 of this minor plat. Mr. Smith advised the Plan Commission that the Board of Zoning Appeals had no action taken on the variance. Mr. Smith presented a written stipulation to the Plan Commission stating that if the minor plat and variance which is currently pending be approved, the Lloyd's will surrender the existing variance for the additional residence upon Lot 1, and there would be only one residence on Lot 1 and one residence on Lot 2 of this minor plat. The stipulation presented to the Plan Commission is part of these minutes. Motion was made by Bill Abbott, second by Charles McGuire to approve the Harold and Jane Lloyd two (2) lot minor plat located at 1062 Keller Hill Road contingent upon the Board of Zoning Appeals approval of a variance of width to depth ratio on Lot 2 of the Lloyd minor plat. The vote was deadlocked at 4 - 4.
