'-~ '- MINUTES OF THE MOORESVILLE PLAN COMMISSION The Mooresville Plan Commission met at its regularly scheduled meeting place, the Town Hall, on August 28, 1986. Present were Board Members Steve Edwards, Tilford Bailey, Joel Bebee, Dave Barry, Vern Kimmell, Wendell Thaler, and William Abbott. The Building Inspector, Joe Beikman was present along with the Board's Attorney Timothy C. Currens. Chairman Edwards found there was a quorum present and proceeded to open the meeting. The minutes of the July meeting were approved as read. The Board proceeded to business from the floor with Horace Adams and other neighbors present regarding the business at l39~ Eàst South Street. Mr. Adams explained that other neighbors were interested including Mr. Derbyshire and Wagner and that their concerns were the current use as a residence and also the business use on the property and the tires stacked on the town right-of-way. In addition they felt the area was an eyesore and disgrace to the town in general. Attorney Currens advised Mr. Adams that the Board had sent a letter to the property owner requesting him to appear at this meeting and likewise had similar concerns. Building Inspector Beikman advised that there was several violations on this property and the construction that was done does not meet code. He also said that the tires were stored on the town right-of-way and the new business of selling televisions was started in the past week. The Board then proceeded to request the attorney to contact the property owner and proceed with enforcement of the ordinance and for Mr. Beikman to red tag the improper construction. The next item to come before the Board was that of the Biviano property on Clay Street. The Board's Attorney said he had not been able to c03tact Mr. Biviano and at this time felt that it would be proper for the Police Department to serve a notice of the violation under the Town Ordinance to the parties living in the residence.
