<br />MINUTES OF THE MOORESVILLE PLAN COMMISSION OF MAY 23, 1985 <br /> <br />"-- <br /> <br />The Mooresville Plan Commission met at its regularly scheduled meeting on <br /> <br />May 23, 1985 at the Mooresville Town Hall. Present were Board Members Dave Barry, <br /> <br />Bill Abbott, Steve Edwards, Ron Alexander, Tilford Bailey, Helen Knight, Vernon Kimmel, <br /> <br />Wendell Thaler and Charles Swisher. Building Inspector Joe Beikman was present along <br /> <br />with Michael A. Ksenak, who was standing in for Board Attorney Timothy C. Currens. <br /> <br />The meeting was called to order by Chairman Dave Barry who acknowledged that a quorum <br /> <br />was present and the Board proceeded to the approval of the minutes of the prior meeting. <br /> <br />Upon a motion duly made and seconded the minutes of the prior meeting were approved. <br /> <br />Finding no business from the floor, the Board moved on to the next item on the agenda, <br /> <br />which was new business. The Board decided to handle the 3 petitions out of order and <br /> <br />requested first to hear the petitions concerning the Hopkins rezoning. Attorney Ksenak <br /> <br />found that proper notice had been served and Attorney Dave Lawson presented the case <br /> <br />'- for petitioners. Mr. Lawson first asked to delete from the petition the request <br /> <br />concerning acoin-operated laundry because that use was already allowed in Local Business <br /> <br />or General Business. Mr. Lawson indicated that the last time his clients were before <br /> <br />the Board was under the old ordinance at which time they had petitioned for rezoning <br /> <br />as General Business. The Board at that time indicated that the uses desired by the <br /> <br />petitioners could be utilized under the Local Business classification and as such <br /> <br />the petition at that time was amended to request rezoning to Local Business. This <br /> <br />year, the Hopkins came in for building permits and due to the new ordinance, they <br /> <br />were informed that the uses requested are only allowed under the General Business <br /> <br />classification. <br /> <br />Mr. Lawson indicated that this area is already a business area and that the <br /> <br />requested rezoning would not adversely affect any of the property in that area but <br /> <br />rather was in fact consistent with the uses already there. The Hopkins simply want <br /> <br />to do what they were attempting to do in 1981. <br />
