<br />MINUTES OF MOORESVILLE PLAN COMMISSION - AUGUST 22, 1985 <br /> <br />'-- <br /> <br />The Mooresville Plan Commission met at its regularly scheduled meeting <br /> <br />on August 22, 1985 at the Mooresville Town Hall. Present were Board Members <br /> <br />Dave Barry, Steve Edwards, Wendell Thaler, Tilford Bailey, Vernon Kimmel and <br /> <br />Inspector Joe Beikman and standing in for Board Attorney Timothy C. Currens was <br /> <br />Michael A. Ksenak. The meeting was called to order by Dave Barry who acknowledged <br /> <br />that a quorum was present and the Board proceeded to the approval of the minutes <br /> <br />of the prior meeting. On motion duly made and seconded, the minutes of the prior <br /> <br />meeting were approved. <br /> <br />The first item of new business was a letter from Maurice Testerman sent <br /> <br />---- <br /> <br />to the Planning Commission informing them that remodeling completed at Millers <br /> <br />Merry Manor has caused water run-off from the property to be channeled right in <br /> <br />to his property causing damage and erosion. Steve Edwards indicates that he <br /> <br />has seen the Testerman property and serious run-off problems do exist. Dave <br /> <br />Barry said it has been this Board's position in the past to require people who <br /> <br />create run-off problems to correct those problems. Steve Edwards moved to <br /> <br />have the Board Attorney draft a letter to Miller's Merry Manor informing them <br /> <br />of the problem and directing them to meet with Building Inspector Beikman in <br /> <br />an effort to remedy the situation. The motion was seconded by Vernon Kimmel <br /> <br />and unanimously carried. <br /> <br />Moving on to old business, the Board questioned as to the status of the <br /> <br />Graybill property. Several Board Members and Inspector Beikman indicated that <br /> <br />Graybill property was still not secure as of this date. Inspector Beikman indicated <br /> <br />that the property has never been properly locked and Vernon Kimmel stated that <br /> <br />this property has been and continues to be a safety hazard. It was the Board's <br /> <br />opinion that this matter should have been filed already since the Board's action <br /> <br />at the July 25, 1985 meeting resolved that a lawsuit should be filed immediately. <br /> <br />'-- <br />
