,

MINUTES OF THE MOORESVILLE PLAN COMMISSION

,-

The Mooresville Plan Commission met at its regularly scheduled meeting on

September 26, 1985 at the Mooresville Town Hall. Present were Board Members

David Barry, Steve Edwards, Tilford Bailey, Bud Swisher, William Abbott and

Vernon Kimmel. Building Inspector Joe Beikman was present and also the Board

Attorney, Timothy C. Currens. The meeting was called to order by Chairman

Dave Barry who acknowledged that a quorum was present. The Board proceeded to

the approval of the minutes of the prior meeting. On motion duly made and seconded,

the minutes of the prior meeting were approved.

The first item of new business was the special exception filed by Cecil and

Ida E. Moore and Shirley J. Moore, 416 Northfield Drive, Mooresville, Indiana

regarding the property located at 135 and 137 W. High Street, Mooresville, Indiana.

The special exception was to operate a plumbing office and shop in the building on

the real estate in question which is currently zoned ITA - Single Family Residential."

Mr. Moore was present and by counsel, Sam Korn. Attorney Currens advised what the

special exception procedure was, in the ordinance, that being for the Plan

Commission to make a determination and recommendation to the Board of Zoning Appeals

as to whether or not the proposed special exception will effect the Master Land

Use Plan in an adverse or positive manner. Attorney Korn went on to advise that

this property had been used for several different business uses throughout the

years and currently it was still zoned "A - Single Family Residential". Steve Edwards

advised that he had some property near this property and was an adjoining property

owner, however, he did not feel that he had any conflict of interest as such and

felt that there would be no problem with the use as a plumbing office and shop

since the property had always had a business use of some type. The other Board

Members agreed and discussed the prior history of the land use. Steve Edwards

made a motion that the Board make a finding that this use would not adversely affect
