<br />MOORESVILLE PLAN COMMISSION <br />MINUlES <br />THURSDAY, JULY 24, 2003, 7:00 P. M. <br /> <br />The Mooresville Plan Commission met on Thursday, July 24, 2003, at 7:00 P. M. at the <br />Mooresville Town Hall. <br /> <br />Commission members present were: Chairman Mike Young, Chris Crouch, Jim Bruner, <br />Troy Bryant, Robert Williamson, Robert Corbin, and John Ehrhart. Commissioners Tim <br />Bennett and Charles McGuire were absent. Town attorney Tim Currens was present. <br /> <br />Springhill Ministries did not appear because the Town Council had approved a rezone to <br />B-1 at their July 15, 2003 meeting. Town attorney Tim Currens told the commission he <br />and Commissioner Bryant had discussed the issue that in the future the Plan Commission <br />make a finding that whenever a decision is not made that the filing is not being certified <br />because the commission needs additional time to look at the application. Commissioner <br />Bryant told the commission he agreed, but didn't know if this was necessary, he said he <br />thought the fact the application was tabled meant the issue was not completed, had not <br />left Plan Commission, and should not have been brought up at the Town Council <br />meeting. The Town Council should not have voted on it. He went on to say he thought <br />the Plan Commission members should all be aware of what happened the other night. <br />The Plan Commission only had six people at the meeting. The vote was 4 to 2 and five <br />votes were needed to make a favorable recommendation or an unfavorable <br />recommendation. Five votes was needed, so the issue was tabled and that is why it is on <br />the agenda tonight and it states in the minutes it was tabled. Commissioner Bryant also <br />said the Town Council canoot vote on a rezone unless it has had one of three <br />certifications, either favorable, unfavorable, or a no recommendation and a tabled issue is <br />not a no recommendation, it is still in the process, but in the future if the commission says <br />tabled it should remain tabled. Town attorney Tim Currens said what we are saying is <br />that the commission is making a specific finding that the application is not certified to <br />anyone. Attorney Currens said he thought that would take care of any doubt out of this <br />issue. Commissioner Bryant agreed that this does. <br /> <br />Ross Holloway of Holloway & Associates appeared before the commission for Shae <br />Corporation arnendment to Section I of Lakeside Commons located on Hadley Road. <br />Mr. Holloway said the amendment was to place a security building within the median <br />area of Lakeside Boulevard and to make these median islands common areas. Building <br />Inspector Joe Beikman told the commission he wanted a sixty-foot setback from Hadley <br />Road. Comissioner Williamson asked if there were any gates involved. Mr. Holloway <br />said no. Motion was made by Commissioner Ehrhart, seconded by Commissioner <br />Williamson to approve security building 105 feet back from the center-line on Hadley <br />Road and in the median of Lakeside Boulevard. Motion carried 7-0. Mr. Holloway was <br />also seeking final plat approval on Section 2 of Lakeside Commons. This area is 1.187 <br />acres and will hold 8 single-family dwellings.
