<br />MOORESVILLE PLAN COMMISSION <br />MINUTES <br />THURSDAY, MAY 27, 2004 <br /> <br />The Mooresville Plan Commission met on Thursday, May 27, 2004, at 7:00 P.M. at the <br />Mooresville Town Hall. <br /> <br />Commission members present were: Chairman, Mike Young, Troy Bryant, Chris <br />Crouch, Robert Corbin, John Ehrhart, Jim Bruner and Robert Williamson. Members <br />Charles McGuire and Tim Bennett were absent. Town Attorney, Tim Currens was <br />present. <br /> <br />A motion was made by Commissioner Ehrhart, second by Commissioner Bryant to <br />approve the minutes of the April 22, 2004 meeting, as amended. Motion carried 7-0. <br /> <br />The fIrst item on the agenda was Holloway Engineering, representing Arvin Hopkins, <br />seeking a rezone on Bridge St. from B3 to I-I, which was tabled from the April 22, 2004 <br />meeting. Mr. Holloway presented the Commission with a letter of commitment on behalf <br />of the applicants, prohibiting four allowable I-I uses on the property. They are: Penal or <br />correctional institution, Commercial facility for breeding non-farm fowl and animals, <br />Commercial slaughterhouse, and Mineral extraction. Ross stated that if the Commission <br />should decide to grant them a favorable recommendation to the Council that the list of <br />prohibited uses would be placed in the ordinance. Commissioner Bryant asked if they <br />had a particular use in mind for this property. Mr. Holloway stated that since the last <br />meeting the idea of the body shop has dissipated, however because of the location being <br />behind the bus garage the I-I zoning would be more appropriate than B-3 because you <br />would not get retail to go back there. Commissioner Young stated that he thought Mr. <br />Holloway was going to bring a list of possible uses and Ross stated that he was, however, <br />after looking at the list of allowable I-I uses, everything other than the four uses <br />prohibited by his letter seemed to be fairly benign. Myron Westenhofer of 560 Bridge <br />Street stated that he thinks the possible uses for I-I are too open and he would like to see <br />the zoning remain at B-3 until a specific use is established for the property. Ross <br />Holloway pointed out that Lot I, which is the lot immediately adjoining the residential <br />area will remain zoned B-3. The property adjoining Lot 2 is the school bus garage and is <br />already zoned I-I. He also stated that it is difficult to market and develop a piece of <br />property without the uses being left open. Commissioner Ehrhart asked if the school bus <br />garage is under a restricted use. Tim Currens stated that since it used to be Weliever it <br />was a pre-existing use. Ross Holloway stated that some of the allowable uses for I-I <br />were truck repair, farm implement sales and warehousing and that in his opinion B-3 <br />zoning could be more intrusive to the neighborhood than I-I. <br /> <br />A motion was made by Commissioner Williamson, second by Commissioner Crouch to <br />grant a favorable recommendation to the Town Council to rezone the property from B-3 <br />to 1-1. Motion carried 7-0. <br />
