<br />MOORESVILLE PLAN COMMISSION <br />MINUlES <br /> <br />The Mooresville Plan Commission met on Thursday, August 26, 2004, at 7:00 P. M. at <br />the Mooresville Town Hall. <br /> <br />Commission members present: Mike Young, Chris Crouch, Jim Bruner, Troy Bryant, <br />Robert Corbin, Robert Williamson, John Ehrhart, and Charles McGuire. Tim Bennett <br />was absent. Town attorney Tim Currens was present. <br /> <br />Commissioner Ehrhart with a second by Commissioner Williamson made a motion to <br />approve the minutes of July 22, 2004. Motion carried 8-0. <br /> <br />Ross Holloway of Holloway Engineering brought a two lot minor plat for George and <br />Opal Fox, north of Section 5 of Roberson Woods to the commission. Lot I consists of <br />fifteen acres and lot 2 consists of 4.9 acres. One of the technical review comments was <br />that they needed to seek permission for a driveway cut from the Town Council. The <br />council granted permission with three restrictions. First, Any driveway granted within <br />the access/utility easement is to be not less than 12 feet in width and asphalt over 8 inches <br />of crushed stone, second, Drainage easements, lots 88-91 in Roberson Woods, Sec. 5 on <br />the eastside the residents were afraid there would be on place for this water to drain, so <br />there is a 100 foot wide drainage easement for these lots and in back this easement <br />widens to 300 feet, making the building line for Lot I 100 feet from the rear of Lots 88- <br />92, and the dwelling standards will be the sarne as Roberson Woods, Sec. 5 which <br />include minimum living area for a one-story at 1800 sq. ft. and for more than one-story a <br />minimum living area of 2400 sq. ft, a seven.1Y. !lPr,fent balance of brick or stone, a <br />minimum of 8/12 roof pitch, eaves and sotfe'nds either wood or hardy plank, gables of <br />wood, hardy plank, brick or stone, no aluminum or vinyl, city water and sanitary sewers, <br />and maintenance of drive maintained on share and share alike basis. Councilman Bryant <br />asked if Sugarberry Court could be used only for the Fox's or if a subdivision were put in <br />would they use Sugarberry. Ross Holloway answered if a subdivision there would be a <br />street of this one. <br /> <br />Bill Cunningham, 1335 Sugarberry, spoke for the Roberson Woods Homeowners <br />Association, wanting a requirement these homes belong to the Roberson Woods <br />Association. Mr. Holloway said they could not agree with those terms. Mr. Cunningham <br />told the commission dues for a year were $75 and they would want them to have the <br />same king of mailboxes, roof pitch, covenants and restrictions, a follow their constitution <br />and by-laws. He said they had a similar problem before and had to hire legal counseL <br />Commissioner McGuire commented this commission did not have jurisdiction over <br />homeowner associations. Commissioner Bryant said this lot was still agriculture and <br />would have to come back before the Plan Commission. Mr. Holloway said any more lots <br />than four would have to come back for a rezone and minor platting. A motion was made <br />by Commissioner Crouch with a second by Commissioner McGuire to approve the two <br />lot minor plat.
