.stated that he felt that residents on Fox Drive would be apposed to the street coming out <br />there. A copy of the presented plat has been sent to VS Engineering, who did the design <br />of the improvements to ~7 and they did not have any issues with it. President Warthen <br />has concerns about having two intersections within 600 feet of 67. He asked if the road <br />design would come back for approval on the PUD. Mike Young said it would and they <br />too bad similar concerns with the road.. President Warthen asked if they would give up <br />the current access onto Allison when the new road was built. Mr. Holloway said they <br />would. <br />A motion to approve the rezone of both parcels, one from Ag to PUD and the other from <br />B-3 to PUD, contingent upon the specifications set forth on the certification, was made <br />by Councilman Clark, second by Councilman Dolen. Motion carried 4-0. <br />The next itezra was the Warpenberg Rezone of the former Century 21 property from B-1 <br />to B-2. The Warpenbergs were not present at the meeting. There was a unanimous <br />favorable recommendation from the Plan Cormnission. There has also been a request for <br />a special exception to operate a bed and breakfast but the property has to be rezoned first. <br />President Warthen asked if the B-2 zoning parking requirements were met and Attorney, <br />Tim Currens said they were. <br />A motion to approve the rezone of the old Century 21 property located at 7 West .High <br />Street from B-1 to B-2 was made by Councilman Clark, second by Councilman Harris. <br />Motion carried 3-1. President Warthen opposed. <br />Fire Chief, Les Farmer presented the Council with quotes for the Mobile Date Terminals. <br />He has separated them into two phases. Spillman bas recommended a server, 4 laptops <br />with associated hardware and the Spillman software. The first phase is estimated at <br />$45,707.00 with the total project estimated at $5$,102.17. Councilman Harris asked if <br />the modules were compatible with the ones purchased by the Police Department. Chief <br />Farmer said they were, however there were only enough licenses purchased for the police <br />department at that. tune. President Warthen stated that they would take the information <br />under advisement and look for funding options. <br />Animal Control officer, Mark Taylor reported 24 calls, 7 impounds and. 4 returns. <br />Town Attorney, Tim Currens stated they he had received a request from LabCo seeking <br />permission to extend their original release with the Town to include the placement of <br />monitoring wells for the rennediation of the building. He will redraft the release to <br />include the streets involved and that they will return them to the existing condition. They <br />are Harrison, Broad Alley and Madison. Tim Currens stated that it will not interfere with <br />the planned paving project. <br />A motion to allow the placement of the wells was made by Councilman Clark. Matian <br />was second by Councilman Dolen and carried 4-0. <br />Tien Currens also presented the Council with an ordinance to establish a Rainy Day Fund, <br />as required by the State Board of Accounts for processing certain monies that are <br />received by the Town_ The ordinance will be effective as of June 1, 2007. <br />A motion to approve Ordinance 12-2007 to establish a Rainy Day Fund was made by <br />Councilman Clark, second by Councilman Dolen and carried 4-0. <br />The last item under Legal was the road dedication for the north end of Town Center <br />Road. <br />A motion to approve the dedication for the final phase of Town Center Road was made <br />by Councilman Dolen, second by Councilman Clark. Motion carried ~1-0. <br />President Warthen asked for a motion to approve the closing of the streets for the annual <br />Old Settlers parade even though no one has made a request, since the parade will be <br />before the next meeting. <br />A motion was made by Councilman Clark and second by Councilman Harris to approve <br />the closing of the streets far the Old Settlers Parade, if requested, as long as no changes <br />~'. <br />have been made. Motion carried 4-0. <br />
