5 <br />Judy Atwood, Springmill Addition, told the council she is still waiting on a meeting with. Mr. Coons. She had found <br />out that Rooker Run was level with Rooker Road when she went over her research of copies of Mooresville Times and <br />Town Council minutes. Brian Haggard, Banning Engineering, Gave a summary a£in£ormation gathered. The soils are <br />sandy and a higher risk of erosion. The erosion has been happening over 15 years or so. Maintenance of the ditch is <br />the respon ibility of the individual l.ot owners. Mrs. Atwood replied, if the homeowner is responsible for maintaining <br />the ditch. how you can maintain something that someone else is causing the problem. She doesn't understand why <br />know one can see that Rooker Trace water is destructing their property. Mrs. Atwood told the council she is getting an <br />attorney because she did not think the council was doing everything they could do. <br />Attorney Currens told her that he relied on the engineer's expertise and none of them have said Rooker Trace runoff <br />was the problem but that problems with the soil and maintenance ofthe ditch ante erosion had started. Joe Beikman, <br />Street Superintendent, commented the ditch where Mrs. Atwood's lot starts is where the problem always was. Pre <br />construction at Springmill shows there was a ditch there and. the developers made it a swail. The first five lots of t <br />addition were not to be disturbed. A homeowners association was in place in the beginning, and then disbanded. <br />Council President Worthen stated that downstream from Mrs. Atwood someone has maintained the swail ditch and it is <br />working. Councilman Shields commented he could not see where any engineer had brought information that Rooker <br />Trace and Rooker Run had caused the problem. <br />A motion was made by Councilman Clark and seconded by Councilman Dolen to approve Resolution #b 17, 2007, to <br />allow the Clerk-Treasurer to make adjustments to wastewater bills amount to $20.00 or less and to allow for write-offs <br />of balances that could not be collected if owners of property could not be found. Motion carried 5-0. A motion was <br />made by Councilman Clark with a second by Councilman. Dalen to appoint Council President Worthen as signatory on <br />this resolution. Motion carried 5-0. <br />Council President Worthen stated that for the past eight years the council had approve a raise of $1,000 across the <br />board. This year funding was available to implement a larger increase to add $1644.00 to full time employees which <br />amount to 80 cents an hour raise for hourly and a 4% increase for part-time employees. A motion was made by <br />Councilman Clark with a second by Councilman Harris to approve salary ordinance #17, 2007. Motion carried 5-0. A <br />motion was made by Councilman Shields with a second by Councilman Clark to make Council President Tom Worthen <br />a signatory on the resolution. Motion carried S-0. <br />Work at Cemetery is coming along and council doesn't see why plots could not be said by year end. The council <br />not have a problem with. Tom Worthen working with Brian Haggard and Eddie Bucker until the first of the new ye <br />2008. <br />Helen Humes wxote a letter of resignation from the Redevelopment Board. A motion was made by Councilman Dolen <br />with a second by Councilman Clark to approve Rex Nichols to be appointed to the Redevelopment Board to replace i <br />Helen Humes. Motion carried 5-0. A motion was made by Councilman Clark with a second by Councilman Harris to <br />approve Tom Worthen as signatory. Motion carried 5-0. <br />Councilman Shields reported on his work to get a-mail established for department to department. The cemetery needs <br />a link for information on locating plots. He stated that January l5`, one of the new council members will need to take <br />over this responsibility. <br />Legal: A motion was made by Councilman. Harris with a second by Councilman Clark to approve an easement <br />agreement with Kurkowskis on old #267. Motion carried 5-0. <br />A motion was made by Councilman Clark with a second by Councilman Dalen to approve the inter local agreement <br />and enter into a contract with SDG on the 1-69 grant`funding and to appoint Mark Harris as signatory. Motion carried <br />5-0. <br />Animal Control Officer, Mark Taylor, reported fifteen (15) calls, six (6) impounds, and four (4) returns. For the year <br />end total he reported five hundred fifty two (SS2) calls, two hundred nineteen (219) impounds, and one hundred <br />eighteen (118) returns. <br />A motion was made by Councilman Clark with a second by Councilman Dolen to approve payment of claims. Motion <br />carried 5-0. <br />Council President Worthen thanked the atlier council members and said he appreciated what they have done far the past <br />nine years he had served. He also thanked his wife and family for putting up with him during his service on the council <br />and he stated he served on the council with pleasure. <br />A motion was made by Councilman Dolen with a second by Councilman Clark to adjourn the meeting. Motion carried <br />S-0. <br />
