i ~G <br />July 11, 200b <br />The Mooresville Town Council met in regular session on Tuesday, July 11, 2006, at 6:30 <br />p.m. at the Mooresville Town Hall. <br />Town Council members present were: President, Town Warthen, Troy Bryant, Jolm L. <br />Clark, Toby Dolen and Eric Shields. Town Attorney, Tim. Currens was present. <br />Council President, Tom Warthen gave the prayer. <br />A motion was made by Councilman. Clark, second by Councilman Shields to approve the <br />minutes of the June 20, 2p06 meeting anal the Declaration of Minutes of the executive <br />session that followed. Motion carried 5-0. <br />The $rst item on the agenda was Richard Kivett, requesting to have a party with a live <br />band at 1023 Killian Drive on July 22, 2006. Mr. Kivett told the council that the party <br />will begin at 2:00 p.m. and would probably end by around 9:00 p.m. He has spoken to <br />and invited all of his surrounding neighbors. He has also spoken to the Police <br />Department about the noise ordinance and was given. a copy. None of the neighbors he <br />had spoken to had any objections. Mr. Kivett did not believe parking would be a <br />problem. He also stated that all of the amplified music would be inside the home and <br />only acoustic music would be played outside and that he would put an ending time on the <br />music of 10:00 if the council wanted him to. <br />A motion to approve the party was made by Councilman Shields, second by Councilman <br />Clark. Motion carried 4-1. Councilman Bryant opposed. <br /> <br />The next item on the agenda was the Election Cost A~-eement from the county for the <br />2007 election. The estimated cost was $7,637.18. President Warthen thought the <br />estimated cost seems high and stated that he had some questions about the agreement that <br />he would like to have answered before signing it. He explained that there are only <br />election costs in the years when there is no state election. Councilman Bryant asked if <br />the town could either extend or shorten the terms for local officials to be on the same <br />schedule as the state elections. Tim Currens explained that the terms are statutory and <br />changing them would require special legislation but he will look into it. <br />A motion was xx~ade by Councilman Shields, second by Councilman Dolen to table the <br />Election Cost Agreement to a later date. Motion carried 5-0. <br />The next item. on the agenda was to review the Animal Control Ordinances. The first <br />ordinance regulates dogs and cats within the Town of Mooresville. President Warthen <br />stated that he likes the way the ordinance is worded and it puts more demands an pet <br />owners. Dollar amounts for fees and fines still need to be added when the Council sets <br />them. On the ordinance identifying dangerous dogs, President Warthen stated that he <br />would like to see the line removed that states that insurance covering a dog deemed to be_ <br />vicious could not be imposed if a reasonable premium is not available. Animal Control <br />Officer, Mark Taylor, stated that he had some questions for Tim Currens about the <br />definition of serious injury. Tirn Currens said he can clean up the wording on that part. <br />A motion to table the Animal Control Ordinances to the first meeting in August was <br />made by Councilman Bryant, second by Councilman Shields. Motion carried 5-0. <br />Under legal, Attorney, Tim Currens presented the Council with a resolution to allow the <br />Mooresville Park and Recreation District to purchase an additiona121.04 acres. He <br />stated that there were two appraisals done and we are paying the average of the two, <br />which makes the cost $165,000 plus closing casts, making the grand total $165,775.05, <br />which will be paid out of the Food and Beverage Fund. Park Board President, Kelli <br />McGuire was present to answer any questions the Council had. Councilman Bryant <br />asked if anyone had discussed an access easement at the corner closest to County Line <br />Road. 'Tim Currens stated that it was not part of the agreement, but Kelli McGuire stated <br />that Brent Callahan had discussed it with one of the property owners. <br />A motion to approve the Resolution for the purchase of the property was made by <br />Councilman Clark, second by Councilman Shields. Motion carried 5-0. <br />
