~r~~ <br />June 21, 2005 <br />The Mooresville Town Council met in regular session on Tuesday, June 21, 2005, at 6:30 <br />P. M_ at the Mooresville Town Hall. <br />Council members present: Council President Tom Worthen, John L. Clark, Toby Dolen, <br />and Eric Shields. Councilman Troy Bryant was absent. Town attorney Tim Currens was <br />present. <br />Dave Dehnke, Harvest Lutheran Church, gave the prayer. <br />A motion was made by Councilman Dolen with a second by Councilman Clark to <br />approve the minutes of June 7, 2005. Motion carried 4-0. <br />Jim Taylor presented "We Care Mooresville" to the council. There are at least twelve <br />churches and over a thousand volunteers to pick up trash, paint, build, repair, etc. an <br />August ] 9, 20, and 21St. Mr. Taylor said they needed more jobs to do. A service will be <br />held on Sunday, August 21, 2005, at 6 P. M. at the Mooresville High School South Gym. <br />Randy Windhorst, Holloway Engineering, presented a rezone for Dan Robert's property <br />an Keller Hill Road from Agriculture to PUD-R. This property is made up of three <br />different plats. Minimum home size for a single story home is 2400 square feet and for a <br />two-story 1200 square feet for each floor. Same lots are five acres and some are two plus <br />acres. The homeowner's association will be responsible for maintenance of the 20 foot <br />wide road constructed to county standards. Na less than fifty percent is to be masonry <br />and no vinyl or aluminum siding is to be used for the homes. The Plan Commission <br />recommended this rezone to the Town Council with a 6-2 vote. Councilman Shields had <br />concerns about the 20 foot vs. a 24 foot width of the road, the size of the cul-de-sac, and <br />what was meant by a dry hydrant, The dry hydrant is to pump water from the pond in <br />case of a fre. Council President Worthen commented that a water tower was across the <br />street, so he didn't understand why Hill Water didn't have fire ratings for that area. <br />Attorney Cuxrens told him the size of pipe is a 4 inch going into the addition and is <br />probably cost prohibitive to upgrade to a 6 inch because they would have to go all the <br />way back to the tower to install a 6 inch. Jessup Place has flush hydrants throughout the <br />addition. This property would also have flush hydrants plus the dry hydrant at the pond. <br />Council President Worthen voiced his concerns about the road width by saying the <br />Council had passed an ordinance to limit surface water to comply with Rule ] 3 specs. He <br />wants to get away from curbs and catch basins to get water to run off easier. He would <br />like to see a twelve inch concrete border on each side of the road which would also tidy <br />up the pavement edge and also have swales and ditches. Mr. Windhorst said their <br />drawing showed a three foot earth shoulder on each side of the road but would be willing <br />to work with. the Council on tlus. Council President Worthen said he would like to go <br />twenty-two feet of road width with one foot each side a concrete border. He also had <br />concerns about the utility buildings. Mr. Windhorst said there would be one on each lot <br />if approved and it had to meet the same construction as the house as set out in item 7 of <br />the covenants. The utility building cannot exceed the size of the home and could not be <br />closer than 50 feet to any property line or from the back of the home. Council President <br />Worthen said he would feel better if covenants read the utility building could not be <br />bigger than 40% of living area of the home. He would rather see not closer than 30 feet <br />from the home and not closer than 70 feet from property lines. He wants to make sure <br />this is compatible with the surrounding area. Mr. Windhorst said he was not authorized <br />to make any commitments. The cul-de-sac is 55 feet lot radius and 45 feet pavement <br />radius. Council President Worthen asked Street Superintendent Joe Beikman if there <br />could be a grassy area in the center. Mr. Beikman said it would be close and Les Farmer, <br />Fire Chief, said the aerial truck could not get around the cul-de-sac. <br />John Littlejohn, Jessup Place, told the Council he was somewhat concerned about the <br />distance from property lines for utility buildings because 50 feet was the length of two <br />Suburbans. There were also no specs far the height of the utility buildings. Also there <br />were no restrictions against a slab home in the covenants. He said it is much easier to <br />include these items in the covenants to begin with. <br />
