Mr. Holloway said the property <br />was zoned agriculture now. They are going to build one home on Lot #l. We are not <br />apposed to putting restrictions on Lot 1 and Lot 2. President Wartheat said without sewer <br />and under Agriculture zoning there could be 15 one-acre lots. Mr. Holloway said if this <br />was rezoned to R1A and with. sewer. there could possibly be 50 to 60 homes on 16,000 <br />square foot lots. Councilman Clark asked if they were willing to annex both, lots into <br />Town. Mr.1"Iolloway said yes, they would even be willing to annex the strip that is <br />called the access and utility easement also and it could be .ran clear to the north end of Lot <br />2 if the Town so desires. These people want sanitary sewers for their home. Mr. <br />Holloway said due to a family situation~they want to move from Roberson Woods and _ <br />build a home on Lot 1 sv they can be close to the zest of their family. They understand <br />that any further division of Lot 1 or Lot 2 they would have to go back to the Plan <br />Couunissioti and go thru the process. They would have a private drive out thru the <br />easement to the end of Sugarberry Court. Mr,1"lolloway said the easement is fifty foot <br />wide like Sugarberry and someday when developed they could dedicate that strip to the <br />Tawn, so the Town would be guaranteed dais would be a Town standard street. Mr. Holloway said maybe they could pave at least 50 feet or they may plan <br />on having ari asphalt drive, he didn't really know for sure. We could say there would be <br />an asphalt drive; that entire portion that is within the access and utility easement and that <br />would keep gravel being tracked onto Sugarberry. President Worthen said, as far as he <br />was concerned, if you could extend Sugarberry in a mangier that we can accept that as a <br />road when it is done, or continue the road on out and the language would also cover size <br />and construction of the homes equal. to or greater than Roberson Woods, l don't have a <br />problem with thaC. Mr. Holloway said he thought this was excessive to request. He <br />doesn't think they would have a problem with saying they would pave afour-inch thick <br />asphalt driveway for twelve or fourteen feet. But his guess was when the rest of George <br />Fox's property develops, somewhere just beyond where the street ends now there might <br />be storm. inlets or there will be changes in grade or something to accommodate the street <br />as it goes on out into his property, so whatever we do now would be second guessing <br />what happens wheia the property develops. President Wartben said with Rule 13, this <br />would be considered a blacktop surface with no storm-water handling. Nlr. Holloway said <br />this would be addressed when plans were broughC in to the Town. When in the future this <br />is extended, we don't mind dedicating the street to the Town. Attorney Currens said they <br />are asking for a driveway permit, not any kind of dedication. Attorney Currens advised <br />the council to wait on any dedications because then it was theirs to improve and wait until <br />it was decided to develop and they would have to meet the standards of the Town of <br />Mooresville otherwise the Town is stuck with road improvement or asking them to do it <br />on Town property. At this point Councilman Clark made a motion to approve driveway <br />access with stipulation of paving the driveway and construction of homes equal to or <br />greater than Roberson Woods. No second because Dave Stegman, Roberson Woods <br />Homeowners Association, asked to speak. 'The association objects to this access due to <br />concerns with a freeway running thru their. subdivision, children on bicycles, and with <br />drainage issues. The association wants to be assured this driveway would end here. He <br />asked Mr. Holloway if he would consider access from Allison Road. kie said there was <br />no law against one entry to a subdivision. President Worthen said that by doing what he <br />is asking tonight might stop Sugarberry from ever going thru. Mr. Holloway said he did <br />isot know if the Fox family wants homes around them. He said he thought for safety and <br />for fire purposes there should not be just one access. Michael Wilson, 1340 Sugarberry <br />Court, spoke to the council about his lots 91 and 92. He said the edge of his lot sits three <br />and one-half feet above the property in question up against a fence. He is concerned <br />about the drainage. He said there was no open end and water went to floe fence. There is <br />no ditch or swale, it just goes out thru the field and kae wanted to know how the two lots <br />would be joined. There is a creek sixty feet away but water doeszi't run to the creek. is <br />drainage from Lot 2 going to flow on the driveway? President Worthen said this Lot l <br />has the discharge area and they cannot do anything with the discharge area. Mr. <br />Holloway answered that is correct. He said they would take the ravine and put a drainage <br />easement across it so it can't be built in and this would probably be required with the <br />building plans. You can put a driveway across the easement; you just can't block the <br />flow. A motion was made by Councilman Clark, with a second by Councilman Dolen to <br />approve the driveway entrance from Sugarberry subject to posting a bond, paving the <br />
