Motion carried <br />3-0 with Councilman Shields abstaining. <br />ACtorney Tim Currens told the council he had a change to the zoning ordinance <br />redefining, a nightclub and puts it into a classification_ The definition reads; a club, both <br />private and public, that is 2500 square feet or greater, provides entertainment and may or <br />may not serve food, drinks, or beverages. A nightclub shall be allowed in a S-3 District <br />by Special Exception only. The Plan Commission unanimously approved to recommend <br />to the Town Council. A motion was made by Councilman Clark, with a second by <br />Councilman Dalen to approve Ordinance #15, 2004, redefining a nightclub. Motion <br />carried 4-0. A mation was made by Councilman Clark with a second by Councilman <br />Dolen to approve on first reading. Motion carried 4-0. <br />A motion was made by Councilman Dolen with a second by Councilman Clark to <br />approve a .Konica Copier lease for the Building Officials affice/Public Works for $305.00 <br />a .month for 60 months. Motion carried 4-0. <br />1 <br />Next, bids on cutting the concrete for the new streetlights. All-Saw had been the lowest <br />bid at $220 per cutting, remove and dispose concrete. The bid from Swinney was #332 <br />per cutting and included marking, barricading, signaling, and removal of concrete. <br />Midwestern bid was for $29,000. A motion was made by Councilman Do1en with a <br />second. by Councilman Clark to accept the Swinney bid at $332 for saw cutting and <br />removal. which included barricading, marking, and traffic control. Motion carried 4=0. <br />Animal Control Officer, Mark Taylor, reported fifteen (l5) calls, ten (l0) impounds, and <br />four (4) returns. <br />A motion was made by Councilman Clark with a second by Councilman Dolen to <br />approve payment of the claims. Motion carried 4-0. <br />A motion was made by Councilman Dolen with a second by Councilman Clark to <br />adjourn the meeting.
