~]~l~ <br />He agrees one hundred percent that he does not want someone other than the Town <br />employees digging the street up and he doesn't think it is the homeowner's responsibility <br />to have to get a surety bond on the performance of the street after they repair it. <br />Councilman Dolen said he thought it should be the Town's responsibility from the <br />homeowner's property line to the sewer main. <br />Councilman Shields said he thought the Town could get in to a big liability if it is left to <br />the homeowner to get their own contractor. Attorney Currens said he and Ceeil Mohr <br />had talked about this and agree on the theory that the lateral should be the homeowner's <br />responsibility, it has to be inspected when it is installed and maybe we could modify the <br />ordinance to address that issue that gives them that responsibility which takes the <br />responsibility for locations off the Town, but where the Town would be responsible for <br />repairs and repairs to the street, Curbs, and sidewalks (the public right of way) in the <br />event of construction on the lateral. Councilman Bryant said he didn't think this was <br />good. The homeowner's responsibility should stop at the right-of--way. <br />Joe Beikman, Street Superintendent, told the council they had done 2771ocates in the <br />first quarter of this year anal that was locating the main lines. He would have to hire two <br />more men to do locates. They are spending three hours a day locating. He was trying to <br />get the liability off the Town if they would run a gas line thru the sewer and the house <br />blows up like happened in soathern Indiana. <br />After more discussion, a motion was made by Councilman Bryant with a second by <br />Councilman Dolen to rescind Ordinance 13, 2004, Article 2, Section 20$ until another <br />way can be decided on. Motion carried 4-l with Councilman Warthen opposed. <br />Attorney Currens told the council by elimunating this the ordinance goes back to the way <br />it was, he would re-draft something showing it rescinded. <br />Animal Control Officer Mark Taylor reported twenty-.four (24) calls, seven (7) impounds, <br />and four (4) returned. <br />Budget 2005 Workshop: Council President Warthen explained to the council Brown <br />Township and Mooresville was still looking for a way to combine both of the fire <br />departments. He said we have to assume it is going to be the same as this year for next <br />year as far as the budget is concerned. Les Farmer, Fire Chief, explained the amounts in <br />his budget and why he felt he needed them to stay in his budget. <br />Joe Beikman, Street Superintendent, explained his budget to the council and the reasons <br />he put the amounts on his budget. <br />David Moore, Utility/Storm Water Department, went over the budget he was given with <br />the council. There wasn't a supervisor when the advertised budget was made out, so <br />Council President Warthen and Clerk-Treasurer Sandra Perry completed the budget for <br />advertising. David related to the council items he needed. <br />Next was the Town Hall budget. Clerk-Treasurer Sandra Perry gave the council a copy <br />of the second cut from the advertised budget. Some of this budget depends on <br />maintaining two Town Halls, how much remodeling the council wishes to do on the Old <br />1Vlethodist Church, and equipment for the new Town Hall if it is to be completed before <br />the end of 2005. <br />August 24, 2004, at 6:30 P.1VI. will be the Preliminary Hearing for Budget 2005 plus a <br />workshop for the Police, Court, and Park budgets. <br />A motion was made by Councilman Clark with a second by Councilman Dolen to <br />approve payment of the claims.
