This project is being dome to limit the <br />inflow and infiltration. A motion was made by Councilman Clark with a second by <br />Councilman Do1en to accept the bid of $318,173.00. Motion. carried 5-0. <br />Jeff Scalf, from the audience, told the Town Council he was asking them for their help. <br />He feels he is being forced into an action he really doesn't want to take. This was in <br />relation to some comments made by Councilman Dolen about John Dillinger_ Mr. Scalf <br />talked to Attorney Currens and Attorney Currens said he was going to turn this over to <br />Hadley, Cook, and Quillen who has the Town insurance. Mr. Scalf said the insurance <br />company would not speak to him. He told the council he was giving them thixty day <br />official notice that if this matter was not dealt with he was going to sue the Town. <br />Attorney Currens brought up the issue concerning Boyd Heights of the bidder that was <br />chosen using a name that didn't exist and wasn't in the name that is incorporated now. <br />Attorney Currens told the council that to cure this problem and be fair to him is to re-bid <br />the project and have those bids by the September meeting. He would have to re-bid <br />under the current incorporated name. Council President Warthen asked if they could <br />have a contract ready to sign at the September 7'~' meeting. Attorney Currens said yes. A <br />motion was made by Councilman Clark with a second by Councilman Shields to re-bid <br />the Boyd Heights contract. Motion carried 5-0. The council asked Mr. Beikman to add <br />the boring to the specifications. <br />Next, Cecil Mohr, a local plumber, spoke to the council in regard to Ordinance 13, 2004, <br />which changed the maintenance and upkeep of the lateral from the main to the home <br />from Town of Mooresville' S responsibility of the main to the property line to the <br />homeowner. This makes general contractors cutting our Town streets, sidewalks, and <br />curbs. Mr. Mohr wanted to give his opinion as someone who works in the industry. He <br />wants the ordinance to go back to the way it was. Councilman Bryant said if the main is <br />-- on the opposite side of the street, this new ordinance places the. responsibility on the <br />homeowner for digging up and replacing the streets, alleys, sidewalks, and curbs and this <br />is an astronomical expense. The omly people you want digging there is a utility cornpa~ay <br />and he thought Ordinance 13, 2004 should be rescinded immediately until they could <br />come up with better wording, Councilman Warthen said locates bother him, he has no <br />problem with repairing of the laterals on Town property. We don't have a mapping <br />system on lateral and in some cases a toilet has to be removed to locate the lateral. He <br />said he and Councilman Bryant had talked about on new building codes there needs to be <br />apiece of wire wrapped around the lateral to where. it can be located. The question there <br />_ ,__ is where do you put the end of the:wire to hook your radio frequency device to pick it up. <br />
