6~8 <br />Don Adams, a High School teacher just retired, but he is teaching a night class of <br />Government appeared before the council to observe the meeting. Don Adams introduced <br />Megan Shirninik and Sadie Roselle, President and Vice President of the Mooresville <br />High School Student Body_ The girls requested permission to have a Homecoming <br />Parade on Friday, October 1, 2004, at 5:00 P. M. using the same route that has been used <br />in the past. A motion was made by Councilman Clark with a second by Councilman <br />Dolen to approve the usual route street closings for the parade. Motion carried 5-0. The <br />Fire Chief and the Police Chief will be notified. <br />Next the council looked at the quotes for a truck that David Moore, Utility Supervisor, <br />had gotten. One quote was from Hubler Chevrolet and was a state bid and to include a <br />plow with the truck the price was $25,324.00. The other bid the council discussed was <br />from Weliever Chevrolet. After deleting $199 for bed rails, adding a snow plow, taking <br />off a $3,500 rebate, and financing a portion of the cost to get $1,500 taken off the cost <br />was $24,359.01. A motion was made by Councilman Clark with a second by <br />Councilman Dolen to approve the Weliever Chevrolet quote and financing $5,000 of the <br />total cost. Motion carried 5-0. <br />President Tom Warthen explained that with the Boyd Heights bid the first bidding they <br />bid in two phases and the second time they did not ask for two phases, it was bid as one <br />single job. At the Sept 7, 2004 meeting President Warthen quoted the first phase only <br />and that was what was voted on. The actual cost bid as a single job was $143,698.00. <br />Councilman Shields made a motion and Councilman Clark a second to approve <br />$143,698.00 for both phases. This money will be paid from Food & Beverage. funds. <br />Legal: Rezone Ordinance #16. A motion was made by Councilman Clark with a second <br />by Councilman Shields to approve Ordinance #16, 2004, to rezone 118 North Indiana <br />Street from B-2 to B-1 for Dr. Fischer, DDS. Motion carried 5-0. <br />A motion was made by Councilman Clark with a second by Councilman Dolen to <br />approve Resolution 11, 2004, rescinding Resolution 8, 2004 for court pre-trial diversion <br />funds. Motion carried 5-0. This money will now be in the General Fund and will help <br />supplement the Court budget. The State Board of Accounts sent a letter approving of <br />this. <br />Councilman Bryant asked Tim Currens is there was any way to expedite the .Turner <br />property suit to get a trial date quicker. Attorney Currens said he would see if he could <br />do some things about this. Councilman Bryant said he had also made some copies of the <br />truck route ordinance from Martinsville and had attached a copy of a picture and would <br />like for them to discuss at the next meeting. Attorney Currens said he believed they did a <br />draft of the ordinance last year and then pulled back. Councilman Bryant agreed. He <br />said basically there were going to be issues of signage, and issues of where we want to <br />route the trucks. He wants to discuss this at the next meeting. Councilman Bryant then <br />asked the council about advertising a bid for the legal counsel. Mr. Curren's contract will <br />be up the end of December. Councilman Bryant said they would probably have until the <br />end of October to decide to advertise for bids. Councilman Dolen said he would not <br />agree to do this, he does not want to advertise for bids. Councilman Clark repeated the <br />same statements. Councilman Bryant made a motion to advertise the bids for legal <br />services. There was no second forthcoming so the motion died. Councilman Shields said <br />he would give some consideration to finding out how Tirn was counsel, the costs to the <br />Town, etc. It was just short notice to say in a month they were going to advertise for bids <br />for legal counsel. He said he did not know how Tim's position carne about; of course I <br />don't dispute the quality of his work. I would consider thinking about it, but would need <br />more time. Councilman Bryant said he could get them some information. Because when <br />you are using tax dollars you want to do the responsible thing and make sure you are <br />getting a fair price. <br />Animal Control Officer, Mark Taylor, reported thirty-five (35) calls, six (6) impounds, <br />and three (3) returns. <br />A motion was made by Councilman Clark with a second by Councilman Dolen to <br />approve payment of the claims. Motion carried 5-0. <br />
