M. at the Mooresville Town Hall. <br />Council members present were President Tom Warthen, Troy Bryant, Toby Dolen, and <br />Eric Shields. John L. Clark was absent. Attorney Tim Currens was present. <br />A motion was made by Councilman Dolen with a second by Councilman Shields to <br />approve the minutes of September 21, 2004 meeting. Motion carried 4-0. <br />Helen Humes, Morgan County Economic Development Director, explained to the council <br />that Riverside Stone was granted atax- abatement in April of 2000. They received both a <br />tax-abatement on a building and atax-abatement on equipment. Riverside Stone <br />delivered the compliance statement to the Council. The other two forms necessary go <br />directly to the County Auditor and the council does not see these. One of the forms <br />Riverside Stone left their signature off of by accident. The Department of Local <br />Government Finance is saying they can't have the abatement an equipment unless the <br />Town Council gives their approval to proceed with the tax abatement. Councilman <br />Bryant commented that the equipment taxes are not captured to the T1F District but was <br />forwarded on to the Town. He said he realized Riverside Stone had been granted the <br />abatement years ago and had planned on this as far as their business was concerned so he <br />would support this action, but if this was a new tax abatement for equipment being <br />requested he would have to vote oppased. A motion was made by Councilman Dolen <br />with a second by Councilman Bryant to approve Riverside Stone's abatement as <br />originally granted. Motion carried 4-0. <br />Next, Doug Turner appeared before the council requesting a permit to put his building <br />~° ~' located at West Main Street in shape. He said his trustees have come to a decision <br />that the appraisal the Town of Mooresville had campleted was on the land only and not <br />on the structure and the Court would very likely throw the case out on the basis the <br />structure is sound. Doug Turner said his engineer had certified the building as stable and <br />the actual damage done by the fire was three switch plates and about 1 S feet of wire. <br />Plumbing wise the building needed one toilet and one lavatory plus a hale in the floor <br />from the fire and he feels like the changes wauld be less than $300 to repair the items and <br />he wanted a permit to make some changes in the electric and plumbing sa he could use <br />the building. But obviously the building was under imminent domain and we were in <br />court over that issue. He told the council that in the last ten years he had been denied a <br />permit consistently, which is the reason for it's current condition. He said once another <br />appraisal is done by the Town the property would be put at a price the Town probably <br />would not want to pay. Councilman Warthen asked Building Inspector Joe Beikman why <br />he had been denied. Mr. Beikman said the last permit application anly had a name and. <br />address an it and nothing else. The property is zoned for business and Mr. Turner needs <br />to file for a change of occupancy with the State of Indiana and needs to bring the building <br />up to code for a commercial structure. Mr. Turner said he had talked to the State of <br />
