MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> SPECIAL EXCEPTION <br /> The Board of Zoning Appeals having held a public hearing on <br /> November 18, 2004 for a Special Exception for a car wash on Lot 3 <br /> Hopkins Minor Plat located on Bridge Street now finds the <br /> following: <br /> 1 . That a public hearing has been held and evidence heard <br /> on this Special Exception procedure. <br /> 2 . That the Mooresville Plan Commission found the Special <br /> Exception would not adversely affect the Master Land Use Plan due <br /> to the location and character of the Special Exception. <br /> 3 . The Board further finds the establishment, maintenance <br /> or operation of the car wash will not be detrimental to or <br /> endanger the public health, safety, morals and general welfare of <br /> the community. <br /> 4 . The Special Exception as a car wash would not be <br /> injurious to the use and enjoyment of other properties in the <br /> immediate vicinity for the purposes already permitted. <br /> . 5 . The establishment of the Special Exception as a car wash <br /> will not impede or substantially alter the normal and orderly <br /> development and improvement of the area surrounding the property <br /> for the uses permitted in the district . <br /> 6. There are adequate utilities, access roads, drainage and <br /> other infrastructure that are being provided. <br /> 7 . Adequate measures have been taken to provide ingress and <br /> egress so designed as to minimize traffic congestion on the <br /> public road. <br /> 8 . This Special Exception of a car wash would be in a <br /> zoning district where such use is permitted. <br /> This Special Exception approved by the Mooresville Board of <br /> Zoning Appeals this 18th day of November, 2004 . <br /> Chairman <br /> \y <br /> Secretar <br />
