• MOORESVILLE PLAN COMMISSION <br /> MINUTES <br /> Thursday July 26, 2007 <br /> 6:00:P. M. <br /> The Mooresville met on Thursday, July 26, 2007 at 6: 00 P. M. at the Mooresville <br /> Government Center. <br /> Plan Commission members present were: Chairman Mike Young, James Logan, Charles <br /> McGuire, Charles Berwick, Darrell Brown, John Ehrhart and Robert Williamson. <br /> Attorney Tim Currens was also present. <br /> A motion was made by Commissioner Logan with a second by Commissioner Ehrhart <br /> To approve the minutes with all of the corrections mentioned. along with a letter that was <br /> read from David Coleman to be attached, the motion carried with none opposed. <br /> Ross Holloway came before the Commission with a letter requesting a continuance for <br /> TOA's Bridge Street project until the August 23 meeting, to provide legal notification of <br /> the new hearing and also give Mr. Holloway and Terry Neer time to discuss a plan for <br /> landscaping. A motion was made by Commissioner Ehrhart and seconded by <br /> Commissioner Berwick to grant the request for a continuance for TOA to return for the <br /> August meeting. The motion carried with none opposed. <br /> STim Currens presented the rezone for Brookmore Lots 85, 86 and 87 for R-1 to R-3. Mr. <br /> Currens explained that 21 &1/2 of the lots on that side were rezone by the county and <br /> these 3 lots were not rezoned at that time. To rezone lots 85, 86 and 87 would be <br /> consistent with what is round them and would be good zoning. Road improvements <br /> would be put in by who ever develops it. Chairman Young asked for questions or <br /> comments from the members, Commissioner Mc Guire said that he had been down there <br /> and feels that the R-3 would be consistent with the other lots. After much discussion <br /> between Jerome Witte, Martin Witte and Tim Currens, Jim White of 45 Allen Drive <br /> spoke to say that he and his wife feel that this rezone would be detrimental to there <br /> property. Commissioner Brown expressed concern with adding 4 Plex units with only <br /> one fire hydrant for the whole subdivision. The only hydrant is at Lewis and. Lehr. The <br /> Building permit for the Four Plex that was built on the lot that was not zoned properly <br /> was brought up again Mr. Beikman said that when he spoke with the County they said <br /> that they only had the card system, and the card had the R-3 zoning for all of the lots in <br /> question. At this Jerome Witte spoke to say that when he went to the County that he got <br /> the book and page number went to the Recorders office and found the correct zoning of <br /> R-1. Jerome Witte wants someone held accountable for the mistake. Mr. Currens <br /> recapped what had taken place when this had first been brought up to the Commission. <br /> He said that when Joe Beikman had a building permit request for a Four Plex he called <br /> the County and was told that the card said that the zoning was R-3.
