TOWN OF MOORESVILLE <br /> PLAN COMMISSION MINUTES <br /> Thursday,November 8, 2007 <br /> • The Town of Mooresville Plan Commission met on Thursday,November 8, 2007 at 7:00 P.M. at the <br /> Mooresville Government Center. Present were Darrell Brown, Mike Young, Charles McGuire, Robert <br /> Williamson, James Logan and John Ehrhart and Charles Berwick. Town Attorney, Tim Currens, was <br /> present. <br /> Motion was made by Charles McGuire, second by Darrell Brown, to approve the minutes for the October <br /> 25, 2007. Motion carried 6-0. <br /> First on the agenda was Ross Holloway, Holloway Engineering,representing Dewey Stewart,requesting <br /> a minor plat consisting of approximately 13 acres located on the west side of Rooker Road just south of <br /> Willwood Manor Subdivision section 3 and the purpose of this plat is to create two lots, lot one is where <br /> the existing buildings are and lot two is where the pond is. Mr. Warthan is purchasing lot two to provide <br /> them with additional area and buffering. Because it is a stand alone building site which meets the septic <br /> requirements and it needs access. To provide for the access they have created a thirty foot wide access <br /> and utility easement out to Rooker Road, that is separate from the existing properties of Sonny Perry. <br /> There is adequate frontage and the parcels do not need any width of depth variances with both parcels <br /> being over six acres. He asked if there were any questions from the board or the audience. There being <br /> no question he asked for a motion to approve or deny the petition. <br /> Motion was made by Robert Williamson, second by Charles McGuire, to approve a two lot minor plat <br /> located on the west side of Rooker Road just east of Willwood.Manor Subdivision on a 12.70 acre parcel. <br /> 0 Motion carried 6.0. <br /> Mike Shanahan, Attorney, representing Mooresville Paint and Body Shop, stated their concerns were the <br /> 70,000 sq. foot building located at 310 N. Indianapolis Road, it is their understanding that the is <br /> construction for condominiums start with in the building and that there is an operator currently living <br /> within the building. In addition they are operating a paint and body shop currently, without having the <br /> proper variance or zoning to do so. They are requesting that the board prevent them from operating <br /> further until they get the proper variances for operation. They are asking that they be fined for the days <br /> they were in violation of the ordinance. <br /> Mr. Currens stated that he had instructed their attorney that if they were operating they should decease <br /> and desist an operation until the building inspector could investigate the complaint. <br /> Mr. Currens stated he had received a letter of complaint on the noise and dust at Carter Lee Lumber. He <br /> said they said they have purchased some dust control and they would see that that was done and address <br /> the other issues. If they need to report to the board they would be more than happy to. <br /> Mr. McGuire stated that he would like for the building inspector to check into the property located on the <br /> property at the entrance to Poe's Restaurant, there seems to be a junk yard start there. Mr. Beikman said <br /> the county had set the zoning there years ago, so he would check with them on the zoning. <br /> The building inspector, Joe Beikman, reported there were 15 permits issued and 16 inspections. <br /> There being no further business to come before the board at this time a motion to adjourn was made by <br /> Charles McGuire, second by James Logan. Motion carried 6-0. <br />
