4 <br /> ORDINANCE NO. . <br /> BEFORE THE TOWN COUNCIL OF MOORESVILLE, INDIANA <br /> UPON THE APPLICATION OF: Jeff Jones & Lorri Jones <br /> AN ORDINANCE REZONING LAND WITHIN <br /> THE JURISDICTION OF THE TOWN OF MOORESVILLE, INDIANA <br /> WHEREAS, a public hearing was held the 28th day of June, 2007, with notice <br /> given as required by the Town Zoning Ordinance upon the application of Jeff Jones & <br /> Lorri Jones, for the rezoning of the real property, Parcel #1 & Parcel #2 described on the <br /> attached EXHIBIT 'A'. <br /> WHEREAS, pursuant to Indiana Code 36-7-4 the Mooresville Plan Commission <br /> made a favorable recommendation to the Mooresville Town Council for said rezoning <br /> request for Parcel #1 from B-3 to PUD Commercial and Parcel #2 from Ag to PUD <br /> Commercial. <br /> NOW WHEREAS, the Mooresville Town Council, after diligent review of the <br /> matters pertaining to rezoning of the above described land at a public meeting held on the <br /> 17th day of July, 2007 find that the requested zoning classification is appropriate, subject <br /> to the following voluntary conditions and restrictions which are to run with the land: <br /> 1. A traffic study will be preformed for the intersection of Allison Road and the <br /> proposed street prior to approval of the final detailed plan for the first <br /> proposed lot. <br />
