One Hundred Dollars ($100 . 00) per day nor greater than One <br /> 40 Thousand Dollars ($1, 000 . 00) per day for each day in which such <br /> dumping occurs . Such damages shall e not less than the actual <br /> costs to the Town of Mooresville of locating the source of <br /> dumping and repairing any damage to the sewage treatment works <br /> caused by such dumping, including attorney fees, sampling and <br /> laboratory costs, engineering fees and all other costs <br /> associated with enforcement and compliance of the Town' s <br /> standards set out in this Ordinance and the Town' s Ordinance 17, <br /> 1989 and any successor Ordinance to this Ordinance. <br /> Section 11 . The invalidity of any Section, clause, <br /> sentence or provision of this Ordinance shall not affect the <br /> validity of any other part of this Ordinance which can be given <br /> effect without such invalid part or parts . <br /> Section 12 . That the rules and regulations promulgated <br /> by the Town, after approval of the Town Council, shall, among <br /> other things, provide for an appeal procedure whereby a user <br /> shall have the right to appeal a decision of the Administrator <br /> of the user charge to the Town Council and that any decision <br /> 111 concerning user charges of the Town Council may be appealed to <br /> the Circuit Court of Morgan County, Indiana under the Appeal <br /> Procedures provided for in the Indiana Administrative <br /> Adjudication Act . <br /> 19 <br />
