if the BZA did the same. Attorney Tim Currens clarified that it would be a
recommendation to the BZA / Council and not a voted on and passed motion.
There was no second on the motion. Commissioner Brown made a motion not to
approve / recommend based on concerns for the Gateway and traffic concerns
presented tonight. Commissioner Dieterlen seconded, the motion did not pass as
Commissioner voted apposed and Commissioner Anderson abstained.
Commissioner Young called for any further motions. Commissioner Brown made a
motion to table the requests, motion passed though Commissioner King did not
vote. Commissioner Young then addressed the official rezone from B2 to B3, Mr.
Bray did want to reiterate a small car lot would be the best possible use of the
space. Mr. Remster currently takes care of the property and that a nice looking
business at that location would look good, for considering the comprehensive plan
as well as potentially increase any sales for the car lot. Mr. Bray again addressed a
small car lot would have steady traffic flow and work best on the parcel of land in
question. Attorney Tim Currens stated that a motion would need to be made to
recommend or not to the Town Council, no motion was made. Commissioner
Dieterlen expressed to Mr. Bray that he may take the additional time given to more
thoroughly address the issues discussed tonight. The Special Exception and Rezone
will both tabled and heard again at the April Plan Commission meeting, neither
will be sent to the Board of Zoning Appeals at this time. The next item on the
agenda is the Cedar Woods update. Dennis Nail, of the building Department went
and looked at the property. The location is zoned agriculture and Mr. nail sees no
visible signs of a business other than lettering on a truck, that can not be seen from
the road, and is no more noticeable than any typical work truck that might be
driven home. Mr. Nail sees no visible zoning ordinance violations. Commissioner
Young asked attorney Tim Currens how the commission should procedd on this
matter, Mr. Currens stated that he himself would write a letter to the individual that
contacted the Plan Commission originally. Dennis Nail then gave his monthly
report, there were 9 permits issued and 26 inspections. Commissioner Young
called for any new business, there wasn't any. A motion was made by
Commissioner Dieterlen to adjourn , the motion was seconded and carried.
Next Meeting: Thursday April 25th, 2013
