1137 <br /> Tom Warthen,Storm Water comments: He told the council Rule 13 compliance issues was an unfunded <br /> mandate that said any water that enters Mooresville has to leave in the same condition. Then the <br /> property tax values changed and went to cash value. The past councils did not put band-aids on the <br /> problems but did improvements without going in debt. Parts A and B got approved by the State and <br /> Part C was started before Ross Holloway was hired in Martinsville to do their plan. The Town was given <br /> permission to enact a fee to run the storm water. The Town adopted it and attached the fee to the <br /> sewer bill. The storm water fee was lienable if not paid. The main issues are floatables and heavy <br /> sediment. The issue is quality. Hendricks County cities and airport is our problem. Rule 13 criteria is: <br /> Did we cause it,Can we fix it, and do we own it. Mr.Warthen said businesses will pass the storm water <br /> ERU fee on to the customers. <br /> Councilman Watkins said the storm water department consists of 1 and one half to 2 people. The <br /> department has been to training a lot for the last 3 years. He doesn't know exactly where problems lie, <br /> but a study will give the Town a plan and the plan has to have documented reasons to raise a fee. <br /> Larry Wyatt living on Victor Drive said he is charged a fee for storm water but does not have a drain. <br /> Councilman Langley commented ditches are a drainage and Attorney Currens reminded him that storm <br /> water is an unfunded mandate. <br /> Councilwoman Perry told the council they have had a public workshop and quotes from Holloway and <br /> DLZ wants to make a proposal. A motion was made by Councilwoman Perry with a second by <br /> Councilman Langley tb ask for quotes due by the first meeting in May. Councilman Watkins commented <br /> he would like to see council develop criteria for both companies to quote on. Council President Mathis <br /> said they need a committee. Councilman Watkins and Councilwoman Perry will be the committee and <br /> will send council and the companies some examples of what other communities have used and want <br /> apples to apples on the quotes. Motion carried 4-1. Councilman Mathis opposed. <br /> Councilman Mathis commented the Park Superintendent found more extensive damage on the pool. A <br /> motion was made by Councilwoman Perry with a second by Councilman Watkins to approve not to <br /> exceed $14,200 out of Park Non Reverting Capital fund. Motion carried 5-0. <br /> A motion was made by Councilman Watkins to approve'claims in the amount of$443,677.20.
